Obama Justice Dept. Argued In Favor Of Using Race As A Relevant Factor To Justify Immigration Stops – CNS

In at least three court cases, President Obama’s Justice Department has argued in favor of federal law enforcement officers using race as a factor in determining whether to stop someone for a suspected immigration violation.

It has done so despite the fact that the Justice Department and the Department of Homeland Security (DHS) report that they do not engage in “racial profiling.”

The Justice Department’s legal arguments in defense of federal law enforcement officers using race as one factor among others in making immigration stops are based on the 1975 Supreme Court decision, U.S. v. Brignoni-Ponce. In that case, the court held 9-0 that an officer making an immigration stop must be able to cite “specific articulable facts” that “reasonably warrant suspicion” that illegal aliens are present.

“Except at the border and its functional equivalents, officers on roving patrol may stop vehicles only if they are aware of specific articulable facts, together with rational inferences from those facts, that reasonably warrant suspicion that the vehicles contain aliens who may be illegally in the country,” the court ruled in Brignoni-Ponce.

The Court said law enforcement officers could not stop a car merely because the occupants appeared to be of Mexican descent, but that they could consider such an appearance as one factor in making a determination that there was “reasonable suspicion” that illegal aliens were present.

“Even if they saw enough to think that the occupants were of Mexican descent, this factor alone would justify neither a reasonable belief that they were aliens, nor a reasonable belief that the car concealed other aliens who were illegally in the country,” the Supreme Court ruled. “Large numbers of native born and naturalized citizens have the physical characteristics identified with Mexican ancestry, and, even in the border area, a relatively small proportion of them are aliens. The likelihood that any given person of Mexican ancestry is an alien is high enough to make Mexican appearance a relevant factor, but, standing alone, it does not justify stopping all Mexican-Americans to ask if they are aliens.”

In 2003, the Justice Department published a “Guide Regarding the Use of Race by Federal Law Enforcement Agencies.” The guide said federal authorities “may not consider race or ethnicity except to the extent permitted by the Constitution and laws of the United States.”

In explaining what was permitted under the Constitution and the laws, the guide cited the precedent of Brignoni-Ponce.

Thus the rule of Brignoni-Ponce decision that ethnicity alone cannot be used to make an immigration stop but can be considered as one relevant factor-has been adopted by both Immigration Customs and Border Enforcement (ICE) and Customs and Border Protection (CBP), both components of DHS.

A Justice Department spokeswoman told CNSNews.com that department could not provide CNSNews.com with a full list of cases in which U.S. attorneys working for the Obama administration cited Brignoni-Ponce in federal court to justify immigration stops. However, court records indicate there have been at least three such cases.

Existing Home Sales Hit 15-Year Low – CNBC

Sales of previously owned U.S. homes dropped in July to their lowest pace in 15 years, an industry group said Tuesday, implying further loss of momentum in the economic recovery.

The National Association of Realtors said sales dropped a record 27.2% from June to an annual rate of 3.83 million units, the lowest level since May 1995. June’s sales pace was revised down to a 5.26 million-unit pace.

Massacre At Somalia Hotel Leaves At Least 31 Dead – Los Angeles Times

Terrorists in army uniforms stormed a hotel in the Somali capital Tuesday, killing at least 31 people, including six lawmakers, in an hourlong blaze of gunfire, explosions and smoke.

The Shabab movement, an Islamic terrorist group fighting the frail internationally backed government for years, claimed responsibility for the attack. Somalia has been a source of instability since the early 1990s.

The top Republican in the House of Representatives called on Tuesday for President Obama to fire his economic team in a speech meant to focus voters on the weak American economy.

Miracle, Joy In Chile: 33 Miners Trapped 17 Days Still Alive – Temple Daily Telegram

Chile’s president Sebastian Pinera euphorically waved the note, written deep inside a collapsed mine, that his country waited 17 agonizing days to see: “All 33 of us are fine in the shelter,” one of the trapped miners wrote in red letters.

42 Killed In China As Jet Misses Runway, Crashes – Washington Times

A Chinese passenger jet overshot a fog-shrouded runway in the country’s northeast and burst into flames Tuesday, killing 42 people and injuring 49 others, state media said.

The Henan Airlines plane with 91 passengers and crew crashed in Yichun city. The plane had taken off from Heilongjiang’s capital of Harbin shortly before 9 p.m. and crashed in heavy fog during landing.

Woman Jailed For Wearing Low-Riding Pants In Court – NOLA

A state judge in Jefferson Parish sentenced a Kenner woman to 10 days in jail Thursday because she was in court with low-riding pants that revealed her underwear and, according to one witness, a bit more.

Kimberly Senette, 23, remained in the Jefferson Parish Correctional Center Friday afternoon, after Judge Steve Windhorst held her in direct contempt of court.

Man Shot In Head Doesn’t Notice For 5 Years – Seattle Post-Intelligencer

A man living in Germany was shot in the back of his head, but it took him five years to realize it. Police said Tuesday that the 35-year-old was hit by a .22-caliber bullet in the town of Herne as he was out in the street partying and drunk on New Year’s Eve five years ago.

The man recalled receiving a blow to the head, but said he didn’t seek medical assistance at the time.

Woman Buries Brother, Discovers Dead Son – Yahoo News

A French woman discovered her 42-year-old son had been buried in the same cemetery where she was attending her brother’s funeral, after she had tried to invite him to the ceremony.

The family were leaving the cemetery near Lille, Wednesday when one of them noticed a temporary wooden gravestone bearing the son’s name and date of birth in an area reserved for poor people.

Man Goes On Rampage After Losing Arm Wrestling Match – Weekly Vice

Erick Lee Blanton, a 25-year-old Florida man was jailed Sunday after he allegedly threw a tantrum after losing an arm wrestling match.

According to Fort Pierce Police, Blanton became upset after he challenged a man to an arm wrestling contest and lost. Investigators say Blanton retaliated for by getting into a red pickup truck and then driving over the home’s lawn and mailbox.

(TPM)- After ostensibly dissing his son — and politicians like him who oppose the Cordoba House project in Manhattan — over the weekend, Ron Paul took to the airwaves to defend Rand Paul’s view on the project while also making it clear he disagrees with it.

To recap: Rand, like many politicians running in tight races this year, is opposed to building the Muslim community center, and has further called on American Muslims to donate the money that would be spent on building the community center to 9/11 victims’ families as a show of “reconcilliation.” In a blog post over the weekend, Ron Paul ripped into views like that, claiming that any opposition to the project was “all about hate and Islamaphobia.”

In a pair of CNN interviews last night and this morning, Ron stuck to his guns about the community center project — opposition is nothing but a political game being ginned up by bigots. He even went so far as to say he and Rand are on “different sides” of the issue. But he said Rand’s opposition to the project did not suggest he’s bigoted toward Muslims.

Paul is a disgrace frankly, He is unfit to serve Alpo to my dog, much less serve the great state of Texas!

Who ya gonna believe, a Marine Corps General, or President Obama

This quote, comes not from a pundit, or politician, or talking head, but from a Marine Corps General, so, I have to think it carries a lot of weight. Rick at Wizbang shares my thoughts.

The top U.S. Marine general said President Barack Obama’s announced July 2011 deadline to start withdrawing troops from Afghanistan had given “sustenance” to the Taliban.

“We know the president was talking to several audiences at the same time when he made his comments on July 2011,” Gen. James Conway told reporters on Tuesday. “In some ways, we think right now it’s probably giving our enemy sustenance….In fact, we’ve intercepted communications that say, ‘Hey, you know, we only have to hold out for so long.’”

The cold, hard, and I would think very easy fact to grasp is that you cannot fight a war when you tell the enemy your moves in advance. You should have objectives sure, but definite timelines? No way that can be an effective strategy.

WASHINGTON – The Obama administration has told the United Nations that America’s human rights record is less than perfect while stressing that the U.S. political system has built-in safeguards that promote improvements.

In its first-ever report to the U.N. Human Rights Council on conditions in the United States, the State Department said some minorities are still victims of discrimination. Despite progress in reforming past unfair policies and practices, the report said “work remains to meet our goal of ensuring equality before the law for all.”

Is he really this stupid? Does he have any idea that America is eons past the UN in respecting human rights?

So, the Ground Zero Mosque is about freedom of religion to the Left?

I am all about freedom of religion, but, it struck me as odd that the Left would be championing the Ground Zero Mosque on those grounds. Warner Todd Huston agrees and looks into the Left’s conveniently timed support of freedom of religion.

As the left falls all over itself to claim that building the Ground Zero Mega-Mosque is the perfect chance to “showcase” our “Constitutional freedoms” and our religious tolerance, there is another state where religious tolerance is not as noticeably on display as it is for New York’s Muslims. Naturally, in Vermont, it is the religious freedom of Christians being denied. To be sure, the Old Media is not nearly as interested in this story. Richard and Joan Downing own a hilltop property in Lyndonville, Vermont and on that property they’ve built a family chapel where they host weekly Catholic services for all. Next to the chapel they have also erected a 24-foot-tall cross called the Cross of Dozulé, a cross that the State of Vermont is insisting that they remove. How does the State of Vermont justify its demands that the family pull down the cross? Vermont officials are citing environmental regulations that give it the power to determine what sort of construction violates the “aesthetics” of Vermont’s scenery.

OK, so I will expect that any second now, the same Leftists screeching about freedom of religion will be all over this case in Vermont! Any second now I tell ya, yep, they are bound to start standing on their religious freedom soap boxes anytime now….., ah, guys, where are y’all.

Iran Starts Nuclear Reactor – Yahoo News

Trucks rumbled into Iran’s first reactor Saturday to begin loading tons of uranium fuel in a long-delayed startup touted by officials as both a symbol of the country’s peaceful intentions to produce nuclear energy as well as a triumph over Western pressure to rein in its nuclear ambitions.

The Russian-built Bushehr nuclear power plant will be internationally supervised, including a pledge by Russia to safeguard it against materials being diverted for any possible use in creating nuclear weapons. Iran’s agreement to allow the oversight was a rare compromise by the Islamic state over its atomic program.

Western powers have cautiously accepted the deal as a way to keep spent nuclear fuel from crossing over to any military use. They say it illustrates their primary struggle: to block Iran’s drive to create material that could be used for nuclear weapons and not its pursuit of peaceful nuclear power.

Iran has long declared it has a right like other nations to produce nuclear energy. The country’s nuclear chief described the startup as a “symbol of Iranian resistance and patience.”

“Despite all pressure, sanctions and hardships imposed by Western nations, we are now witnessing the startup of the largest symbol of Iran’s peaceful nuclear activities,” Ali Akbar Salehi told reporters inside the plant with its cream-colored dome overlooking the Persian Gulf in southern Iran.

In several significant ways, the Bushehr plant stands apart from the showdowns over Iranian uranium enrichment, a process that can be used both to produce nuclear energy or nuclear weapons. It also could offer a possible test run for proposals to ease the impasse.

The Russian agreement to control the supply of nuclear fuel at Bushehr eased opposition by Washington and allies. Bushehr’s operations are not covered by U.N. sanctions imposed after Iran refused to stop uranium enrichment. And last week, State Department spokesman P.J. Crowley said the Russian oversight at Bushehr is the “very model” offered Tehran under a U.N.-drafted plan unveiled last year.

That proposal – so far snubbed by Iran – called for Iran to halt uranium enrichment and get its supplies of reactor-ready material from abroad.

Western leaders fear Iran’s enrichment labs could one day churn out weapons-grade material. Iran claims it has no interest in nuclear arms, but refuses to give up the right to make its own fuel.

Iran has some of the world’s biggest oil reserves, but lacks refinery capacity to meet domestic demand and must repurchase fuel on international markets. Nuclear power is seen as both a goal to meet power needs and an important technological achievement for the Islamic government.

The French Foreign Ministry said the Russian deal shows Iran does not need to enrich uranium to benefit from civilian nuclear power.

British Pop Singer Commits Suicide At Belgian Music Festival – Daily Mail

A British pop singer climbed up a satellite mast and plunged to his death after playing in front of a sell-out crowd. Charles Haddon’s fatal fall took place hours after a girl had been injured by another member of his group diving off the stage.

Haddon, 22, was said to be ‘very down’ after Friday’s gig at the Pukkelpop festival in Belgium, which attracted 180,000 people.

Man Accused Of Neglecting 178 Cats – Appleton Post-Crescent

Fond du Lac County prosecutors have filed 20 misdemeanor charges against a Portage man accused of neglecting 178 cats and keeping dead kittens wrapped in foil in his refrigerator.

The charges against Allan Roach, 57, were filed this past week, although the alleged offenses were observed in June 2008. Dist. Atty. Dan Kaminsky said the delay was caused in part by employee turnover in his office.

Australian Election Delivers Hung Parliament – The Telegraph

With 75% of the vote counted and the final tally predicted to give 73 seats to the conservative Liberal-National Coalition and 72 to Labor, neither party was likely to reach the 76 seats needed to claim victory in the House of Representatives.

Russian Police Detain Opposition Leader – NewsMeat

Police prevented about 100 opposition activists from marching through Moscow on Sunday with a giant Russian flag and detained two of their leaders, including prominent politician Boris Nemtsov.

The opposition activists were celebrating Flag Day, a holiday honoring the flag adopted by Russia when the Soviet Union collapsed. Nemtsov said the decision to stop the march showed the mentality of Putin’s government.

Donald Douglas on Moderate Muslims

Douglas links Claire Berlinski, who talks about the many Muslims she knows in Istanbul, who are just people, Douglas also offers his take, I think both are highly important to read and study.

Claire Berlinski lives in Istanbul. She’s got an interesting blog post, “Is Islam Itself the Enemy?“, and there’s a raging debate on her Facebook page. This comment struck me as profound:

I’ve just walked down a street filled literally with thousands of Moslems of exactly the kind many people are seriously arguing do not exist. I saw them with my own eyes, as I have every day for the past five years. With so many other questions in the world, why waste time debating this? Book a ticket to Istanbul, spend an afternoon here, have a lovely time, drink some tea, meet friendly, tolerant, warm, welcoming Moslems (mostly), and see for yourself. They exist! They’re my neighbors and my friends! Babür, is there anyone at our gym, for example, who would not describe himself as a Moslem? Would any member of our gym endorse terrorism, honor killing, forcing me to wear the hijab, or subjecting me to a dhimmi tax? The idea is so absurd it’s beyond discussion — and yet we’re discussing it.

Yes, this is good. And I think it’s important. Every once in a while I have Muslim students in class, and we have thoughtful discussions. But they are such a small minority that we don’t get a critical mass of opinion to sort out variations in opinion within the Islamic community. So, call me agnostic on the kind of experience Claire Berlinski’s having. More immediate to me is David Horowitz’s experience. I have had a few similar to this, in my engagement with the ANSWER Coalition. And this kind of experience is a good test. I have come to believe that the biggest issue in dealing with Islam is this. There are MANY great Muslim people, and there are, sadly, tragically, many Muslims who are radical, the thing is how do we identify and know who the good Muslims are? We are a society based in large part on freedom of religion, so where do we draw the line? We are a nation fighting an evil enemy, Islamist terrorists. Where do we draw the line on how to ID and destroy terror threats and cells located here?

Tough questions indeed, but we gain nothing by blindly following the path the Left seems intent on taking, there is no moral relativism between radical Islam and fundamentalist Christianity. There is nothing but peril in the idea that we must put blind “tolerance” above common sense either. The biggest aid we could have is for those good and decent Muslims to speak out against Jihad, and against terrorism, and against those who support implementing Sharia Law here. Those Muslims are as welcome here as any other faiths are. Terrorism is as much their enemy as it is ours, and they have as much to benefit from its defeat as any other American.

Terrorism expert and National Review contributor Andy McCarthy asks an excellent question about the proposed mosque near Ground Zero. How would this play out if the situation was reversed?

A friend poses the following: Imagine that there really were these fundamentalist Christian terror cells all over the United States, as the Department of Homeland Security imagines. Let’s say a group of five of these terrorists hijacked a plane, flew it to Mecca, and plowed it into the Kaaba.

Now let’s say a group of well-meaning, well-funded Christians — Christians whose full-time job was missionary work — decided that the best way to promote healing would be to pressure the Saudi government to drop its prohibition against permitting non-Muslims into Mecca so that these well-meaning, well-funded Christian missionaries could build a $100 million dollar church and community center a stone’s throw from where the Kaaba used to be — you know, as a bridge-building gesture of interfaith understanding.

What do you suppose President Obama, Mayor Bloomberg, the New York Times, and other Ground Zero mosque proponents would say about the insensitive, provocative nature of the proposal?

Do you think the State Department would make the leader of the Christian missionaries a special emissary and send him to represent the United States on diplomatic business overseas?

Now, I know what you are thinking.You are thinking that certainly McCarthy thought of that on hs own,and I am sure he did, after all he is a very bright guy. America was the first nation designed by the people to govern themselves, to overcome the idea that society needed a structure of elites, local geniuses who would make sure society ran on a logical path. Even the Magna Carta was between the nobles and the king, not the peasantry. America elevated the peasantry, it did not eliminate poverty, it eliminated systematic, indentured poverty, then reinstituted it under the liberal “programs.” Until the concept of welfare and social security poverty was a matter of individual circumstance, but welfare, by eliminating the requirement of work for survival, guaranteed poverty on a grand scale.

When America was free and unfettered from hundreds of federal regulations it fostered the greatest age of invention ever spawned from a nation in its infancy. With barely a century under its belt, America was the incubator of all great technological advancements. And, while most incentives have been removed, restricted, or commandeered by the government, America is still capable of incredible advancements.

NEW YORK (CBS 2) – From the inside-out, there may be a new “no-go” when it comes to smoking.

Mayor Bloomberg’s anti-smoking crusade could be coming to a city park or public beach near you, a plan plenty of people say crosses the line, reports CBS 2′s Dave Carlin.

CBS 2 has learned that Mayor Bloomberg is looking at a possible smoking ban for all city parks and public beaches.

“Now you’re gonna stop me from smoking in the park? Where am I gonna smoke at?” West Side resident Anthony Cintron said.

“What’s next? It will be something else in six months,” said another New Yorker.

Oh that little control freak is at it again, he wants to control every last aspect of your life. What a truly despicable human being!
