Why The 14th Amendment Does Not Confer Citizenship On The Children Of Illegal Aliens

Excerpt – It is my considered opinion that Congress has authority under Section 5 of the Fourteenth Amendment to define the jurisdiction of the United States. Indeed, it is my contention that Congress has exercised that power on many occasions, most recently in the Immigration Reform and Control Act of 1986.
Senator Jacob Howard, the author of the citizenship clause in the Fourteenth Amendment, defined who would fall within the “jurisdiction of the United States”:
[E]very person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States. This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons. It settles the great question of citizenship and removes all doubt as to what persons are or are not citizens of the United States. This has long been a great desideratum in the jurisprudence and legislation of this country.
Clearly, the author of the citizenship clause intended to count “foreigners,” “aliens,” and those born to “ambassadors or foreign ministers” as outside the “jurisdiction of the United States.” Senator Howard knew, as his reference to natural law indicates, that the republican basis for citizenship is consent. This is the natural law principle of the Declaration of Independence that proclaims that legitimate governments derive “their just powers from the consent of the governed.”
Senator Lyman Trumbull, Chairman of the Judiciary Committee and a powerful supporter of the Fourteenth Amendment, remarked on May 30th, 1866, that the jurisdiction clause includes those “Not owing allegiance to anybody else… It is only those persons who come completely within our jurisdiction, who are subject to our laws, that we think of making citizens; and there can be no objection to the proposition that such persons should be citizens.” This was familiar language. The Civil Rights Act of 1866 had defined citizens of the United States as “all persons born in the United States, and not subject to any foreign power, excluding Indians not taxed.” It is universally agreed that the immediate impulse for the passage of the fourteenth amendment was to constitutionalize the Civil Rights Act of 1866. This was an attempt to put the question of citizenship and matters of Federal civil rights beyond the reach of simple congressional majorities. Thus it is clear that the idea of allegiance (“not subject to any foreign power”) was somehow central to understanding the jurisdiction clause of the fourteenth amendment.
Much of the debate about the jurisdiction clause in the Congress centered on the status of Indians. The immediate question was whether the fourteenth amendment would confer citizenship upon the Indians as well as upon the newly freed slaves. The former slaves, of course, had been born in the United States and had always been subject to its jurisdiction. Was the same true of Indians? Indians were surely born in the United States, but were they subject to its jurisdiction in the sense of “[n]ot owing allegiance to anybody else?” Senator Trumbull noted that “[t]he provision… that all persons born in the United States, and subject to the jurisdiction thereof, are citizens’… means subject to the complete jurisdiction thereof.” Trumbull proceeded to deny that Indians were “in any sense subject to the complete jurisdiction of the United Sates… We make treaties with them, and therefore they are not subject to our jurisdiction… It cannot be said of any Indian who owes allegiance, partial allegiance if you please, to some other Government that he is subject to the jurisdiction of the United States’.”
The author of the citizenship clause, Senator Howard, emphatically agreed with Trumbull’s assessment that Indians would not become citizens of the United States as a result of the passage of the fourteenth amendment:
the word jurisdiction,’ as here employed, ought to be construed so as to imply a full and complete jurisdiction on the part of the United States, coextensive in all respects with the constitutional power of the United States, whether exercised by Congress, by the executive, or by the judicial department; that is to say, the same jurisdiction in extent and quality as applies to every citizen of the United States now. Certain, gentlemen cannot contend that an Indian belonging to a tribe, although born within the limits of a State, is subject to this full and complete jurisdiction.
Clearly, insofar as Indians owed tribal allegiance they were not within the jurisdiction of the United States, even though there were born within its territorial limits and in many instances subject to its laws. It is important to note here that jurisdiction does not mean simply subject to the laws of the United States. Rather, it refers specifically to political jurisdiction in the sense of allegiance. Aliens in the United States are properly subject to the laws of the United States and the jurisdiction of its courts; but this is not the same as owing allegiance to the United States. Aliens subject to the laws of the United States still owe allegiance to another country and are thus not within the political jurisdiction of the United States the only jurisdiction contemplated by the fourteenth amendment.

Maxine Waters on Friday blamed the Bush administration for her ethics problems — saying she had to intervene with the Treasury Department on behalf of minority-owned banks seeking federal bailout funds — including one tied to her husband — because the Treasury Department wouldn’t schedule its own appointments.
The California Democrat said in a Capitol Hill news conference — an event rarely held during a congressional recess — that she reached out to then-Treasury Secretary Hank Paulson in late 2008 when his department failed to respond to the National Bank Association’s request for a meeting.
“The question at this point should not be why I called Secretary Paulson, but why I had to,” she said. “The question at this point should be why a trade association representing over 100 minority banks could not get a meeting at the height of the crisis.”

Russia: Iran’s Nuclear Plant To Get Fuel Next Week – Washington Times
Russia will load fuel into Iran’s first nuclear power plant next week despite U.S. demands to prevent Iran obtaining nuclear energy until the country proves that it’s not pursuing a weapons capacity, officials said Friday.
Uranium fuel shipped by Russia will be loaded into the Bushehr reactor on Aug. 21, beginning a startup process that will last about a month and end with the reactor sending electricity to Iranian cities, Russian and Iranian officials said.
“From that moment the Bushehr plant will be officially considered a nuclear-energy installation,” said Sergei Novikov, a spokesman for the Russian nuclear agency, told The Associated Press.
Russia signed a $1 billion contract to build the Bushehr plant in 1995 but it has dragged its feet on completing the project.
Moscow has cited technical reasons for the delays, but analysts say Moscow has used the project to press Iran to ease its defiance over its nuclear program.

Russian officials say, however, that U.N. sanctions against Iran, including a new, more stringent set approved in June, don’t directly prevent Moscow from going ahead with the Bushehr project. It has argued that the Bushehr project is essential for persuading Iran to cooperate with the U.N. nuclear watchdog and fulfill its obligations under international nuclear nonproliferation agreements.
Russian officials did not say why they had decided to move ahead with loading fuel into the Bushehr plant now.
The uranium fuel used by the Bushehr plant is enriched to a level too low to be used in an nuclear weapon. Iran is already producing uranium enriched to that level – about 3.5 percent – and has started a pilot program of enriching uranium to 20 percent. Iran claims it needs the 20 percent enriched uranium to produce fuel for a medical research reactor, but the move has further heightened international concerns about its nuclear program.
Uranium must be enriched to over 90 percent to be used in a nuclear warhead.
Iran’s semiofficial ISNA news agency quoted Vice President Ali Akbar Salehi, who is also the head of the Atomic Energy Organization of Iran, as saying that the country had invited International Atomic Energy Agency experts to watch the transfer of fuel, which was shipped about two years ago, into the Bushehr reactor.

2 NC Men Rescued After Being Trapped In Hot Dryer – Yahoo News
Firefighters rescued two North Carolina men from an industrial clothes dryer after they were overcome by heat. One man got into the dryer to free an item that was jammed and he was overcome by the heat.
A second man went in to rescue him and was also overcome. Authorities say the two men were working in a Carolinas Medical Center laundry facility around 1:15 a.m. Thursday.

Carol is none too pleased, and she is right. This is an outrage!
Interesting news in a Washington Times editorial this morning. It is all worth reading, including the first part, which deals with the strong evidence that, in funding Imam Feisal Rauf’s sojourn to the Arabian Peninsula, the State Department is effectively paying for him to raise funds for the Ground Zero mosque project — broadly opposed by Americans who are also being kept in the dark about its financing.
Then there’s the next part of the editorial:
Americans also may be surprised to learn that the United States has been an active participant in mosque construction projects overseas. In April, U.S. Ambassador to Tanzania Alfonso E. Lenhardt helped cut the ribbon at the 12th-century Kizimkazi Mosque, which was refurbished with assistance from the United States under a program to preserve culturally significant buildings. The U.S. government also helped save the Amr Ebn El Aas Mosque in Cairo, which dates back to 642. The mosque’s namesake was the Muslim conqueror of Christian Egypt, who built the structure on the site where he had pitched his tent before doing battle with the country’s Byzantine rulers. For those who think the Ground Zero Mosque is an example of “Muslim triumphalism” glorifying conquest, the Amr Ebn El Aas Mosque is an example of such a monument – and one paid for with U.S. taxpayer funds.
The mosques being rebuilt by the United States are used for religious worship, which raises important First Amendment questions. U.S. taxpayer money should not be used to preserve and promote Islam, even abroad. In July 2009, the Office of the Inspector General published an audit of U.S. Agency for International Development (USAID) faith-based and community initiatives that examined whether government funds were being used for religious activities. The auditors found that while USAID was funding some religious activities, officials were “uncertain of whether such uses of Agency funding violate Agency regulations or the Establishment Clause of the First Amendment to the Constitution” when balanced against foreign-policy objectives.
For example, our government rebuilt the Al Shuhada Mosque in Fallujah, Iraq, expecting such benefits as “stimulating the economy, enhancing a sense of pride in the community, reducing opposition to international relief organizations operating in Fallujah, and reducing incentives among young men to participate in violence or insurgent groups.” But Section 205.1(d) of title 22 of the Code of Federal Regulations prohibits USAID funds from being used for the rehabilitation of structures to the extent that those structures are used for “inherently religious activities.” It is impossible to separate religion from a mosque; any such projects will necessarily support Islam.

How The Obama Administration Is Preempting Federal Immigration Law – Powerline
Two days ago, the Washington Times reported that the union that represents rank-and-file field agents at U.S. Immigration and Customs Enforcement unanimously passed a “vote of no confidence” for the agency’s leadership. The National Immigration and Customs Enforcement Council of the American Federation of Government Employees, which represents 7,000 ICE agents and employees, stated that ICE has “abandoned” its core mission of protecting the public to support a political agenda favoring amnesty. The vote, by the Union’s Council, was 259-0.
Has this story made it into the mainstream media? Not to my knowledge. My friend Craig Harrison asked me to imagine what would have happened if the EPA union voted unanimously to support a statement that Bush was not enforcing environmental laws. I think we can imagine the reaction if a handful of EPA employees issued such a statement.
The union denounced John Morton, who heads ICE, and Phyllis Coven, assistant director for the agency’s office of detention policy and planning. It stated that the integrity of the agency “as well as the public safety” would be “better provided for in the absence of Director Morton and Assistant Director Coven.”
Among the other points unanimously agreed to are these:
* The majority of ICE’s enforcement and removal officers are prohibited from making street arrests or enforcing U.S. immigration laws outside of the jail setting.
* Hundreds of ICE officers nationwide perform no law enforcement duties whatsoever because of resource mismanagement within the agency.

* ICE detention reforms have transformed into a detention system aimed at providing resortlike living conditions to criminal aliens based on recommendations not from ICE officers and field managers, but from “special-interest groups.”
* The lack of technical expertise and field experience has resulted in a priority of providing bingo nights, dance lessons and hanging plants to criminals, instead of addressing safe and responsible detention reforms for noncriminal individuals and families.
* Unlike any other agency in the nation, ICE officers will be prevented from searching detainees housed in ICE facilities, allowing weapons, drugs and other contraband into detention centers – putting detainees, ICE officers and contract guards at risk.
* Senior leadership ignores reports that ICE internal investigations by the office of professional responsibility conceal agency and supervisor misconduct and are used to retaliate against employees who make whistleblower-type disclosures or question inappropriate policies and procedures.
The Obama administration has been touting the fact that deportations of illegal aliens have increased by about 10 percent over what they were under President Bush. But according to the union, illegal immigrants now being held in state and local jails seek out ICE agents for deportation to avoid prosecution, conviction and prison terms. Criminal aliens, it says, “openly brag” that they are taking advantage of a broken immigration system and will be back in the United States within days to commit crimes – while U.S. citizens arrested for the same offenses serve prison sentences.
Under these circumstances, it seems particularly outrageous for the Obama administration to claim that Arizona acted unconstitutionally by passing a law that attempts to enforce federal immigration laws. It is the executive branch of the federal government, not the state of Arizona, that is in serious tension with the immigration laws passed by the United States Congress.

The race for the U.S. Senate in Florida continues to be all about Governor Charlie Crist and former state House Speaker Marco Rubio, regardless of which Democrat they face.
The latest Rasmussen Reports telephone survey of Likely Voters in Florida shows Rubio with 38 percent of the vote and Crist at 33 percent if Congressman Kendrick Meek is the nominee. Meek earns 21 percent.

Stocks Drop Sharply On Investor Fears – KMSP
U.S. stocks declined sharply Wednesday, the biggest drop in six weeks, after heightened concerns for global economic recovery led investors to sell stocks and riskier assets.
The Dow Jones Industrial Average dropped 265 points, or 2.5 percent, to 10,379, with all 30 Dow components in the red. The Nasdaq Composite fell even further, plunging 69 points, or three percent to 2,209.

Blagojevich Jury Deadlocked – Chicago Sun-Times
Jurors told Judge James Zagel in a note that they have been unable to reach a unanimous decision on some or all counts against Rod Blagojevich and asked for guidance on how to proceed.
Zagel read the note aloud in court with a nervous-looking Blagojevich looking on. “We have gone beyond reasonable attempts” to reach a unanimous decision and “now ask for guidance,” the note said.

Rights Group: Ugandan LRA Rebels Abduct, Kill Hundreds – Reuters
Uganda’s Lord’s Resistance Army rebels have abducted 697 people in central Africa in the last 18 months, killing many of them, according to a human rights group investigation.
“The LRA has killed at least 255 adults and children, often by crushing their skulls with clubs,” said Human Rights Watch, which spent a month gathering evidence on attacks in Central African Republic and Congo.

Foreclosures Surge 9% From June To July – CBS News
The number of U.S. homes lost to foreclosure surged in July, another sign lenders are moving quicker to take back properties from homeowners behind in payments.
Lenders repossessed 92,858 properties last month, up 9 percent from June and an increase of 6 percent from July 2009. Banks have stepped up repossessions this year to clear out the backlog of bad loans.

Dem Lawmaker Calls On Gibbs To Resign – Canada Free Press
A Democrat member of Congress called for White House press secretary Robert Gibbs’s resignation Tuesday due to inflammatory comments he made about the “professional left.”
Rep. Keith Ellison (Minn.), a member of the Congressional Progressive Caucus (CPC), said Gibbs went over the line when he told The Hill that some left-wing critics of the president “ought to be drug tested.”

Rather than seeking to export American exceptionalism, and elevate other nations, they seek to import the ideals that have failed the less successful nations. And they speak of “equality”? Yes, it is equality they will reap if the succeed. An equality of misery and far lower standards of living. It is sheer madness to tear down those that excel, to “even the playing field”. There is no level playing field. That is a utopian pipe dream the Left has held dear for decades. A dream based on the great lie of Marxism. The lie that promises that by punishing success, and restricting “greedy Capitalism” we can have everyone be equal, with all our needs met, all our healthcare provided, all our children raised and educated for free, and that somehow we will all live in sheer ecstasy.
The reality, of course, is that this promise always leads to one place. It leads to a dictatorial government that restricts and eventually crushes our liberty, our individualism, and eventually our hope!

(Daily Caller)- A New Hampshire candidate for the state house is taking heat from the state Republican Party after he wrote on a Facebook thread that he wishes former Alaska governor Sarah Palin and the father of her grandson were in the plane crash that killed former Sen. Ted Stevens in Alaska on Monday.
“Just wish Sarah and Levy (sic) were on board,” wrote Keith Halloran, a Democratic candidate for Cheshire County House District 7, referencing Palin and Levi Johnson, the on-again, off-again boyfriend of her daughter.
What a despicable thing to say, and who wants to bet the media gives this clown a pass? However, imagine if the parties were reversed? Think the media would be so forgiving?
