26 States Join Suit Against Obamacare – Fox News
Six more states joined a lawsuit in Florida against President Obama’s health care overhaul on Tuesday, meaning more than half of the country is challenging the law.
The announcement was made as House members in Washington, led by Republicans, debated whether to repeal the law.
The six additional states, all with Republican attorneys general, joined Florida and 19 others in the legal action, Florida Attorney General Pam Bondi said.
“It sends a strong message that more than half of the states consider the health care law unconstitutional and are willing to fight it in court,” she said in a statement.
The states claim the health care law is unconstitutional and violates people’s rights by forcing them to buy health insurance by 2014 or face penalties.
Government attorneys have said the states do not have standing to challenge the law and want the case dismissed.
Lawsuits have been filed elsewhere. A federal judge in Virginia ruled in December that the insurance-purchase mandate was unconstitutional, though two other federal judges have upheld the requirement. It’s expected the Supreme Court will ultimately have to resolve the issue.

“It is important to note that two of the three courts that have reviewed this law on the merits have found it constitutional, and those decisions – as well as two others the government prevailed on – are pending in courts of appeal. At the same time, trial courts in additional cases have dismissed numerous challenges on jurisdictional and other grounds that have not been appealed,” Justice Department spokeswoman Tracy Schmaler said.
Meanwhile, the White House dismissed an expected vote on repealing the law, saying the Republicans’ push was not a serious legislative effort. Democrats have a majority in the Senate and they have said they will block repeal in that chamber.
In the Florida case, the states also argue the federal government is violating the Constitution by forcing a mandate on the states without providing money to pay for it. They say the new law gives the state’s the impossible choice of accepting the new costs or forfeiting federal Medicaid funding.
Florida U.S. District Judge Roger Vinson could rule later this month whether he will grant a summary judgment in favor of the states or the Obama administration without a trial.
Florida’s former Republican Attorney General Bill McCollum filed the lawsuit just minutes after President Obama signed the 10-year, $938 billion health care bill into law in March. He chose a court in Pensacola, one of Florida’s most conservative cities. The nation’s most influential small business lobby, the National Federation of Independent Business, also joined the suit.
Joining the coalition in the Florida case were: Iowa, Kansas, Maine, Ohio, Wisconsin and Wyoming.
The other states that are suing are Alabama, Alaska, Arizona, Colorado, Georgia, Indiana, Idaho, Louisiana, Michigan, Mississippi, Nebraska, Nevada, North Dakota, Pennsylvania, South Carolina, South Dakota, Texas, Utah and Washington.

Could George Washington be far behind? Apparently not!
Yesterday all across America, there were celebrations commemorating and celebrating the life of Dr. Martin Luther King Jr. One such commemoration occurred on the state house steps in Columbia South Carolina, where the NAACP used the holiday to not only commemorate the King holiday, but they also utilized the holiday to march to the state house steps to protest the continued presence of the Confederate flag being flown on state property at the Confederate Memorial.
Rally draws 1,200 to State House
Marchers once again took on the Confederate flag during Monday’s King Day at the Dome rally, but they also spoke out against the 150th anniversary of South Carolina’s secession and legislative proposals to cut state spending on education and pass tougher anti-illegal immigration laws.
On a side note, something else occurred on the state house steps of South Carolina yesterday. Something that seems to have completely escaped the notice of the majority of media in America. It too was a part of the protest and it was a backdrop to the speakers present to deliver their speeches as part of the NAACP protest. But no one seems to have taken much notice of it and it seems to have been completely overlooked by most everyone in the media involved in covering the protest in South Carolina. See if you can spot what occurred.

Someone at the rally reported that there was concern that Washington’s statue might “offend” someone. So, if it might, even possibly offend “someone” we must cover it up, erase it, delete it, silence it hide it, abolish it…………..
Yet another blow to our historical heritage.

The South Carolina NAACP has responded to a request for comment and said the only reason the statue of Washington was covered up was for aesthetic purposes. “We had created a backdrop behind the speakers,” the group spokesman told The Blaze late Tuesday afternoon. According to the group, the statue of Washington has been covered each year for the annual rally. The spokesman said he was “at a loss for words” as to why covering President Washington would offend anyone, claiming it was “non-sensical” for people to believe it may have been politically motivated.
They are curious as to why anyone would be offended at censoring George Washington? Hmmmm, interesting that the NAACP is absolutely obsessed with not being offended, yet, they are perplexed at offense over THEIR actions? Not to mention the extreme level of intolerance the NAACP was displaying by attacking the flag and the Confederate memorial. And how funny is it that the NAACP is shocked that anyone would accuse them of a politically motivated act. EVERYTHING the NAACP does is a political stunt! Good grief!

Man Caught Masturbating During Police Interrogation Over Burglaries – Weekly Vice
Jonathan B. Gambino, a 28-year-old Evesham man accused of burglary earned an additional charge when he allegedly decided to masturbate while police were questioning him about the alleged crime.
According to the Burlington County Police Department, Gambino was jailed Friday after he reportedly stole an estimated $88,000 worth of electronics, jewelry, and other valuables from an Evesham resident.

He is also a suspect in a series of other burglaries on the area and was in possession of Xanax that hadn’t been prescribed to him when police arrested him.
Investigators say that, while in the interrogation room, he began masturbating while shouting profanities at the officers on duty.
Gambino remained in the Burlington County Jail and was charged with burglary, theft, possession of drugs and lewdness. He is being held in lieu of $55,000 bail.

Detroit May Close Half Of Its Schools To Pay For Union Benefits – The Blaze
A report from the Detroit News Monday suggested that without government aid, the city of Detroit will be forced to close down nearly half of the city’s public schools in the next two years. Additionally, the paper warns that average high school class sizes will swell to 62 students by the following year.
These startling statistics were laid out in a deficit-reduction plan filed with the state of Michigan by the city’s Emergency Financial Manager Robert Bobb. Bobb’s role is working to slash the $327 million deficit the Detroit school district has accrued over the years.
According to the Detroit News, Detroit Public Schools considered filing for bankruptcy in 2009 but declined. In the past year alone, debt in the district has increased by more than $100 million, brought on by a “mix of revenue declines in property taxes, reduced state aid, declining enrollment and an unplanned staffing surge this past fall.”
While Bobb and DPS administrators have a lot to account for, noticeably absent from the discussion is the role of the teachers unions.
As students suffer amidst increasing classroom sizes and declining school choices, the district’s teachers stand to earn higher salaries. The city’s contract with the Detroit Federation of Teachers requires payments for teachers whose class sizes exceed specified maximums. So while Bobb demands increased class sizes to save the district money, the district is simultaneously estimating the move will create $10 million in additional costs to pay teachers’ oversize class pay over the next four years alone.

The Wall Street Journal notes the city s decaying public school system:
“Additional savings of approximately $12.4 million can be achieved from school closures if the District simply abandons the closed buildings,” the proposal explains, purging costs like boarding up buildings, storage and security patrols.
Steven Wasko, a spokesman for Mr. Bobb, said that urban property sales have been difficult, in part because until recently the state board of education banned transactions with “competing educational institutions” like charter schools. Once buildings are deserted, even if the doors and windows are welded shut with protective metal covers, scavengers break in and dismantle them for copper wire, pipes and so on.
Under the emergency plan, consolidated high-school class sizes would increase to 62 by 2014, “consistent with what students would expect in large university settings.” Yet under the terms of the Detroit Federation of Teachers contract, the district must pay bonuses for class enrollment over 35, thus imposing some $11.1 million in new costs through 2014.
Note that this dispensation carries about the same price tag as the school abandonment windfall: In other words, Detroit may end up destroying serviceable capital assets so it can pay its public workers more over the short term.
Mr. Wasko cautions that the school closure plan is a last resort, and Mr. Bobb has floated other ideas, including a financial restructuring similar to the GM bailout/bankruptcy. Detroit Federation of Teachers president Keith Johnson rejected even that because “The children of Detroit are not consumed products of a profit-driven corporation like a car,” as he wrote in an op-ed this week. Maybe his real objection is that the GM model might allow the district to rationalize its labor liabilities.
The budget gap is party due to the property tax revenue collapse as the Motor City crumbles, as well as financial mismanagement and a surge in pay and benefits for public employees. The Mackinac Center, a state think tank, reports that average Michigan teacher salaries outpaced those of all other states from 2003 to 2009, when adjusted for state per capita income as a proxy for the local ability to pay.
It’s hard to think of a sadder commentary on a government so fiscally desperate and so captured by its workers that it may be forced to abandon property to thieves. But are they the scavengers or the union?

Media outlet after media outlet panned Sarah Palin’s video response to last Saturday’s Tucson shootings with some going so far as claiming it ended any chance she might have of becoming president assuming that’s even her goal.
Destroying this myth was a new poll published by Media Curves that actually found Americans seeing the former Alaska governor as more likeable, sincere, and believable after watching her speech:
Respondents were asked to rate Sarah Palin on a scale from 1-7 regarding likeability, believability and sincerity, with 1 representing “not at all strong in this attribute” and 7 representing “extremely strong in this attribute.”
With the exception of likeability among Democrats, Palin’s attribute ratings increased among all parties after viewing her speech. The most notable increase was her sincerity ratings, which increased from 2.62 to 2.69 among Democrats, from 5.25 to 5.45 among Republicans and from 3.68 to 3.85 among Independents.
The poll also found:
- An increase in the number of Democrats, Republicans, and Independents that see her as a positive figure in the United States after viewing the speech
- 40 percent of Democrats, 81 percent of Republicans, and 56 percent of Independents feeling the speech helped her image
- 37 percent of Democrats, 78 percent of Republicans, and 54 percent of Independents feeling the speech helped her potential run for president
Look, I am not saying she will run, I am not saying she will be nominated IF she runs, but, I am saying that she will gain in popularity the more people see her, and not the carefully manufactured media caricature of her!

For a decade, from the election of Bush 43 forward, the Left has lied and cheated as it tried to return to power. Al Gore made a mockery out of the American electoral system by being a spoilsport over Florida, which Bush indeed won by 537 votes. Dan Rather forged a document to try to derail Bush’s re-election. Twice Democrats stole U.S. senators from the Republicans. After voting to support the war to get by the 2002 election, many Democrats quickly soured on the war. The profane protests were cheered by liberals who misattributed “dissent is the highest form of patriotism” to Thomas Jefferson; the words belong to the late historian Howard Zinn.
Once in power, liberals were the opposite of gracious.
For two years now, I have been called ignorant, racist, angry and violent by the left. The very foul-mouthed protesters of Bush dare to now label my words as “hate speech.”
Last week, the left quickly blamed the right for the national tragedy of a shooting spree by a madman who never watched Fox News, never listened to Rush Limbaugh and likely did not know who Sarah Palin is.
Fortunately, the American public rejected out of hand that idiotic notion that the right was responsible.
Rather than apologize, the left wants to change the tone of the political debate.
The left suddenly wants civil discourse.

America has made good on that bounced check due to “insufficient funds,” and black people were made whole and then some. The black man is no longer an exile in his own land, as King suggested in the ‘60s. When King spoke of the shameful condition of the black man, it was real and at the hands of white Democrats. Today however, if there is a shameful condition of the black man, it is a condition of the black man’s own creation.
There can be no argument that black people have advanced to the highest possible levels in America, and black Liberals know in their hearts that the sky is the limit as far as the potential for black achievement. No longer do black Liberals need to feel disingenuous when encouraging their children that they could one day be president of the United States. Despite all the overwhelming examples of achievement by blacks however, Liberal black people still complain more than any other culture about America; calling America racist, and saying that the black man is being kept down. They are right. But it is Liberal blacks keeping Liberal blacks down.
Black Liberals are conditioned to complain, the same way a child tries to get his way. Meanwhile millions of illegal immigrants stream across our borders happy to trade places with any American and millions more line up legally to do so. All over the world, the longest line of any embassy line is the line at the American embassy. MLK would smile that America remains the country that people all over the world still fight to get to.

Raymond Royal Marshall, a crucial cog on syndicated talk show host Neal Boortz’s radio team as a sidekick and engineer, has died.
Pete Spriggs, program director for AM750 and now 95.5 FM News/Talk WSB, said he collapsed at his Atlanta home and was pronounced dead at Grady Hospital at about 1 a.m. early Saturday morning.
Assistant Program Director Condace Pressley said it was too soon to pinpoint cause of death. He was 43.
“He was a good man,” she said. “I can’t believe he’s gone.”
Marshall worked with WSB Radio for 17 years, according to the WSB Radio biography for Marshall.

UPDATE (Monday, January 17, 2010 at 10 a.m.): WSB Radio said Marshall had a fatal heart attack Saturday. His funeral service will be held at Ray of Hope Christian Church in Decatur Saturday at 11 a.m. It’s open to the public. WSB aired a tribute to Marshall Monday morning. Boortz announced the death of Marshall to his national syndicated network listeners at 10 a.m. Erick Erickson subbed in for Boortz today. Boortz said he will be back on air Tuesday morning live.
A St. Louis native and graduate of the University of Georgia in 1992, he got his start at WSB Radio as a board operator working overnights. Soon after, he joined Boortz as engineer and board operator.
In 1996, he started his own radio talk show called “The Royal Treatment,” which ran for several years, mostly at night.
After his show ended, he continued to work with Boortz, who is heard on hundreds of stations nationwide.
“There are no words available to express my personal sense of loss at the passing of Royal Marshall,” Boortz said in a statement released this morning. “It’s no stretch to say that I loved that man like he was my own brother. Royal had an unmatched sense of humor and a quick mind that made him a natural for radio, and his dedication to his colleagues and friends was only exceeded by his intense dedication to his family. Our program, WSB Radio and the entire Cox family has lost part of its very soul this day.”
“He was always upbeat, always in a good mood,” said Mark Arum, a traffic reporter for WSB Radio for 13 years. “He was always there with a quick line. We were always each other’s sounding board. He was always ready to lend a friendly and understanding ear.”
Rahul Bali, Marshall’s producer from 1998 to 2005, said he watched Marshall mature from happy-go-lucky bachelor to devoted father and community member. “He just grew up,” he said.
Marshall was a deacon at the Ray of Hope Christian Church in Decatur and chair of the national advisory board at Forever Family, a non-profit organization which helps children who have parents who are incarcerated.
Marshall also dabbled in stand-up comedy at the Punchline for a few years. “He had an easy way with people and was very comfortable with the mike,” said Jamie Bendall, who owns the Punchline. “I thought he was a natural.”

In that WSB Radio story, executive producer Belinda Skelton said: “For 15 years it’s been Royal and Belinda. My other half is gone. I don’t know if I can sit and look at someone else on the other side of that glass.”
The station did tributes all afternoon. Arum and Clark Howard joined Adam Goldfein to take calls and reminisce.
Marshall is survived by his wife Annette and two daughters, two-year-old Ava and four-year-old Amira.
