Homeland Security (DHS) Secretary Janet Napolitano does not have the authority to refuse to enforce laws that require illegal immigrants to face deportation, according to the federal judge hearing the Immigration and Customs Enforcement union’s lawsuit against DHS.

“The court finds that DHS does not have discretion to refuse to initiate removal proceedings [when the law requires it],” U.S. District Judge Reed O’Connor said today, per Business Week. O’Connor asked DHS and the ICE union to offer additional arguments before he makes a final ruling on the legality of President Obama’s “deferred action on childhood arrivals” (DACA) program, which invoked prosecutorial discretion as a means of allowing people to stay in the country if they would have qualified for amnesty under the DREAM Act, which never passed through Congress.

The judge’s comments come one day after Napolitano scolded the union, during a Senate Judiciary Committee hearing on the Gang of Eight’s immigration bill, for challenging the policy she and Obama have implemented.

“There are tensions with union leadership, unfortunately,” Napolitano told Sen. Jeff Sessions, R-Ala., yesterday. “Here’s what I expect as a former prosecutor and attorney general: that is that law enforcement agents will enforce the law in accordance with the guidance they are given [by] their superiors.”

Sessions faulted Napolitano for refusing to meet with the ICE officers’ union. “I have never heard of a situation in which a group of law officers sued their supervisor, and you, for blocking them from following the law,” he said. “They weren’t complaining about pay, benefits, working conditions – they were saying their very oath they took to enforce the law is being blocked by rules and regulations and policies established from on high, and that this is undermining their ability to do what they are sworn to do.”

The “Gang of Eight” senators will release their immigration bill on Tuesday, just one day before the only scheduled hearing, according to news reports, bolstering GOP charges that advocates are planning to rush the controversial bill through the Senate before the public knows what is in it.

The bill is to be released April 16, according to a Friday report by The Associated Press.

The next day, before other senators have time to understand what is in the complex bill, Vermont Democratic Sen. Pat Leahy is slated to hold an April 17 hearing with one witness, Homeland Security chief Janet Napolitano.

There is no evidence that Democrats plan to hold additional hearings that would help senators — and Americans — to get testimony from immigration, police and wage experts about the workability and impact of the bill, which reportedly includes more than 1,000 pages.

The Democrats’ blitz has prompted protests and requests for additional hearings from GOP Senators, including Alabama Sen. Jess [ed.- they mean Jeff] Sessions, the ranking chairman of the Senate’s budget committee.

Every Senator in the Gang of Eight Ass Hats should be forced to resign like the disgraces they are. And do not give me that “but it is a bi-partisan bill” crap either! Homeland Security Secretary Janet Napolitano promised to release more illegal immigrants into the United States, saying the budget sequester has left her no choice.

Several hundred detainees have already released because of the sequester, she insisted. They were released on bail, or because their legal status had changed, she said.

“We’re going to continue to do that… for the foreseeable future,” Napolitano said at a March 4 breakfast meeting hosted by Politico. “We are going to manage our way through this by identifying the lowest risk detainees, and putting them into some kind of alternative to release.”

However, Napolitano’s statement clashed with a March 1 report by The Associated Press, which said that internal agency documents show that her managers had already released 2,000 detainees, and planned to release 3,000 more detainees.

Napolitano’s threat reflects the White House’s determination to ramp up public distress until the GOP ages to another tax increase.

Under the sequester, budgets at the Pentagon and the numerous civilian agencies are being cut by roughly 8 percent from March to September. The cuts will trim roughly 1 percent from federal spending in 2013.

President Barack Obama suggested the sequester plan in 2011, and is now refusing any changes until the GOP agrees to tax increases.

There are roughly 11 million illegal immigrants in the country, of whom roughly 7 million are working, mostly in low-skill jobs. However, roughly 20 million Americans are without jobs, including several million Americans with few job skills.

In the run-up to the 2012 election, Obama offered work permits to more than 750,000 illegals, and rolled back enforcement of immigration law.

Napolitano’s threat to release more illegals was not criticized by Tom Ridge, a former secretary of Homeland Security under George W. Bush, who was also interviewed at the Politico breakfast.

Instead, Ridge complained that the controversy over the illegals’ release threatened passage of the draft immigration rewrite.

Progress towards a legislative success “gets sidelined – well, did you release 2,000? Didn’t you release 2,000? What about this, what about that?” Ridge complained.

The pending rewrite would offer immediate work permits to roughly 11 million illegal immigrants, a path for their relatives to join them in the United States, plus a ramped-up flow of foreign workers into the United States, despite the high unemployment rate.

“The job of the secretary of Homeland Security… with regard to securing the border would be a heck of a lot easier if the U.S. Congress would forget about the partisanship and come up with a broad-based, comprehensive immigration plan,” Ridge complained.

“Story ends right there,” said Ridge, who is now a consultant to various business groups, and a board member of the American Action Forum.

The forum is a business-linked advocacy group that is promoting the pending immigration rewrite. It is chaired by Fred Malek, a GOP donor and activist, who owns the Thayer Lodging Group. The group owns several hotels, some in partnership with a Chinese hotel firm.

Ridge’s complaint was backed by Napolitano. “Ditto, absolutely,” she said.

Napolitano’s promise to release more prisoners was indirectly criticized by Michael Cherthoff, who also served as secretary of the Department of Homeland Security.

To win passage of an immigration revamp, the public needs to be reassured that immigration enforcement will continue after the law is passed, said Cherthoff, who led President George W. Bush’s effort in 2006 to push through a controversial amnesty law. The effort was backed by business Republicans and progressives, but was derailed by a wave of public protests.

“Making people confident there will be continued enforcement and security, and it won’t go away once you have some kind of amnesty” is vital, he said.

He also warned Napolitano that legislators need to rush the draft rewrite through Congress before the opposition can mobilize.

In 2006, “the time between agreement and getting it to the floor really allowed a lot of erosion from both the right and let… [so] you’ve got to move it it quickly,” said Chertoff, who is now employed by Covington & Burling, a large legal and lobbying firm.

Why is the government buying millions and millions of bullets?

Andrew Malcolm reminds us that the Department of Homeland Security is still buying up ammunition. Lots of it. But they won’t say why, and it’s not the only federal agency buying bullets by the boatload.

In a puzzling, unexplained development, the Obama administration has been buying and storing vast amounts of ammunition in recent months, with the Department of Homeland Security just placing another order for an additional 21.6 million rounds.

Several other agencies of the federal government also began buying large quantities of bullets last year. The Social Security Administration, for instance, not normally considered on the frontlines of anything but dealing with seniors, explained that its purchase of millions of rounds was for special agents’ required quarterly weapons qualifications. They must be pretty poor shots.

But DHS has been silent about its need for numerous orders of bullets in the multiple millions. Indeed, Examiner writer Ryan Keller points out Janet Napolitano’s agency illegally redacted information from some ammunition solicitation forms following media inquiries.

According to one estimate, just since last spring DHS has stockpiled more than 1.6 billion bullets, mainly .40 caliber and 9mm. That’s sufficient firepower to shoot every American about five times. Including illegal immigrants.

To provide some perspective, experts estimate that at the peak of the Iraq war American troops were firing around 5.5 million rounds per month. At that rate, DHS is armed now for a 24-year Iraq war. (Read More)

Troubling? Yes, I was sitting here, wondering why the government would do this? Some possible answers include:

To limit availability, and or drive up the price? Sort of a back door form of gun control? I know there are other theories out there about more fiendish plots, but I am not buying into those. I do not think the government is looking to start killing us off. But, this ammo buying spree is interesting.

Emerging from her bedroom dressed in her Hoodie-Footie pajamas, still clutching one of her several dozen stuffed animals and an empty quart of Ben & Jerry’s, bleary-eyed from watching all of Season III’s Sex And The City episodes in one sitting, Mzzz Marcotte apparently dragged herself to her Apple and fired off this Tweet:

It takes a lot to get the Admiral peeved, but, as you’ll see by reading his comments here, Manda managed to do it. A highlight:

Two points. First, if Marcotte truly believes her own words she is beneath Janet Napolitano on the IQ scale, Napolitano placing slightly below a tree stump, and slightly higher than Jimmy Carter. Second, the image of Marcotte that Belvedere paints is freaking hilarious!

This also got me thinking about other stupid people, like Andrea Mitchell, or pretty much anyone else on MSNBS. The “news” network is current stuck on full-blown anti-Romney mode, and they are going through baseless, inane attacks like Michelle Obama through ugly clothes. Their current strategy seems to center on Romney’s use of the word “foreign”, which, it seems is a word that the gang at MSNBS does not know the definition of. Smitty, has the latest example featuring Mitchell, who seems to be suffering from a nerve condition that causes her to repeatedly place both her feet in her mouth

 

Clearly, Romney’s use of ‘foreign’ is going after ‘alien to traditional American thought’. And, yes, the Marxist underpinnings of Obama’s collectivist thinking are foreign, to put it as mildly as possible.

For safety reasons, I recommend Andrea Mitchell and Amanda Marcotte  maintain a two-mile standoff, lest their combined intellectual suction trigger a singularity.

Stacy McCain also takes a shot at Marcotte, and why not, she is like a crash test dummy, with a lower IQ of course!

In case you don’t remember, Marcotte was one of two left-wing women whom John Edwards recruited in 2007 to boost his presidential campaign’s connection to the progressive blogosphere. Alas, this turned out to be a very short-term gig when it was discovered what manner of “political commentary” Marcotte and her comrade Mellissa McEwan had hitherto provided their readers, as eloquently summarized by Mary Katharine Ham: “Vote for Edwards, Godbag Christofascists!”

Marcotte and McEwan are both radical feminists of the most extreme variety, generally arguing that the Republican Party is a theocratic plot for the patriarchal oppression of womyn. According to Judicial Watch, Homeland Security Secretary Janet Napalitano is actually considering waving airport pat downs for Muslim women who consider them offensive.

We mustn’t offend the Muslims!

The demand came last week from the politically-connected Muslim rights organization that serves as the U.S. front for the Palestinian terrorist group Hamas. Calling the searches “invasive” and “humiliating,” the Council on American-Islamic Relations (CAIR) advises Muslim women wearing religious head covers known as hijabs to reject full-body checks before boarding planes.

Those who are selected for the secondary screenings should remind Transportation Security Administration (TSA) officers that they are only supposed to pat down the head and neck and that they should not subject Muslim women to a full-body or partial body pat-down, according to CAIR’s advisory.

Homeland Security Secretary Janet Napolitano is actually considering exempting Muslims as per CAIR’s demands. Madame Secretary confirmed this week that there will be “adjustments” and “more to come” on the issue of Muslim women in hijabs undergoing airport security pat-downs.

Aha. CAIR is dirty, and certainly does not have America’s best interest at heart. So, why would Janet Napolitano ever consider caving to this group? Well because, Napolitano is dumber than a tree stump for one thing. Recall she said our border with Mexico is more secure now than ever before. And she sees people like Chris, and myself as more dangerous that the terrorists CAIR supports behind the scenes. Oh, and of course as Ed pointed a couple of days ago, and as Chris notes, we all know that those darned wheel-chair bound toddlers are the real menace

But toddlers in wheelchairs? TSA makes them do the Full Monty, right out in the open. Because when it comes to hijacking planes, everyone knows just how dangerous those toddlers really are.

DHS report: “significant variability in the ideologies motivating terrorist attacks across decades.”

Good Freaking Grief! why do we even have a DHS? Seriously, Janet Napolitano is in incompetent buffoon who could not find her ass with both hands!

A new Homeland Security report compares terrorism to “ordinary crime” in metropolitan U.S. cities and omits the radical Islamic factor, instead finding “significant variability in the ideologies motivating terrorist attacks across decades.”

This appears to be part of the Obama Administration’s Muslim outreach effort, which includes hiring a special Homeland Security adviser (Mohamed Elibiary) who supports a radical Islamist theologian and renowned jihadist ideologue. The Obama Justice Department also created a special Muslim Engagement Advisory Group to foster greater communication, collaboration and a new level of respect between law enforcement and Muslim and Arab-American communities.

And, in 2010, Homeland Security Secretary Janet Napolitano held secret meetings with radical Arab, Muslim, Sikh and South Asian “community leaders.” Judicial Watch uncovered documents from the Department of Homeland Security (DHS) that includes a list of the individuals who participated, including radical leaders such as Hezbollah supporter Imad Hamad and extremist Salam Al-Marayati, founder of the Muslim Public Affairs Council.

Considering this cozy relationship, the new DHS terrorism report should come as no surprise. It compares terrorist attacks to “ordinary crime” in large, metropolitan areas which is why the nation’s terrorism “hot spots” are Manhattan, Los Angeles County, Miami-Dade County Florida, San Francisco County and Washington, D.C. As if to downplay the distinct difference between crashing a plane into a high-rise and a mugging, the DHS says “terrorism and ordinary crime occur in many of the same areas.”

It stresses that the “Ideological motivation” for terrorist attacks varies greatly. For instance, the brilliant DHS minds found that certain counties are prone to a particular type of terrorist attack, including extreme right-wing, ethno-nationalist/separatist and “religiously motivated,” though no specific religion is mentioned. The report does point out however, that “religiously motivated attacks occurred predominately in the 1980s.”

And we continue to pour tax dollars into the cesspool of stupidity! Talk about useful idiots!

According to this story the Department of Homeland Security may have found a new threat, and that threat is…..Rick Perry. The story is just breaking and as of this time there are few details but it appears as if a member of the Department of Homeland Security, Mohamed Elibiary, accessed documents which were meant strictly for official use and quickly decided that leaking them to the press constituted official use.

  Yes, he approached us and gave us some reports marked FOUO [For Official Use Only] that he said showed a pattern of Islamophobia at the department. He emphasized that some of the regional fusion centers were shut down a few years ago after the ACLU complained that they were targeting Muslim civil rights groups and said that this was being directed by [Texas Gov.] Rick Perry

  It appears as if Mohamed Elibiary’s intent was to use these documents in an attempt to bring down a political opponent of Barack Obama but:

We looked at the reports and they weren’t as he had billed them to us. They seem to be pretty straightforward, nothing remotely resembling Islamophobia that we saw. I think he was hoping we would bite and not give it too much of a look in light of the other media outfits jumping on the Islamophobia bandwagon

Well, I have said that Perry likely scares Obama more than any other candidate, which is why the Left has attacked him so. But think of this. The DHS being used to bring down political foes of you know who?

Walsh added that Holder needs to explain to the American people what role he had in Operation Fast and Furious. “The American people deserve to know the truth regarding Attorney General Eric Holder’s knowledge and role in the Fast and Furious operation,” Walsh said. “This program was deliberately designed to attack law-abiding American gun owners and gun dealers. Why else would an anti-gun administration force licensed firearms dealers to sell guns to violent criminals?”

This ought to be obvious. The administration has been repeating the lie that lax gun laws here are to blame for the heavily armed drug cartels in Mexico. Apparently Team Obama is willing to sacrifice lives to achieve their Stalinist dreams of stricter gun control.

(AZ Daily Star)- Border Patrol agents shot beanbags at a group of suspected bandits before the men returned fire during a confrontation in a remote canyon, killing agent Brian Terry with a single gunshot, records show.

And an illegal immigrant wounded in the gunbattle who is now the only person in custody linked to the slaying contends he never fired a shot, according to FBI search warrant requests filed in the U.S. District Court in Tucson.

The documents provide the most detailed version yet of what happened in the deadly gunbattle Dec. 14 in Peck Canyon, northwest of Nogales.

The documents say the group of illegal border entrants refused commands to drop their weapons after agents confronted them at about 11:15 p.m. Two agents fired beanbags at the migrants, who responded with gunfire. Two agents returned fire, one with a long gun and one with a pistol, but Terry was mortally wounded in the gunfight.

Border Patrol officials declined to answer questions about protocol for use of force, citing the ongoing investigation.

But Terry’s brother, Kent Terry, said the other agents who were there that night told him that they were instructed to use the non-lethal beanbags first. It’s a policy that doesn’t make sense to Kent Terry.

“You go up against a bandit crew that is carrying AKs, and you walk out there with guns loaded with beanbags – I don’t get it,” Terry said in a phone interview from Michigan. “It’s like going to the Iraqi war with one knife. It boggles my mind. … These guys (Border Patrol agents) are professionals; they should be able to use their judgment call on their own.”

As I said IF this is accurate then every American should be beyond irate frankly. If this is true there is but one thing to blame, and that one thing is political correctness! Yes, it has been said and still rings true PC can and DOES KILL! A sane policy would dictate that our law enforcement officers would be fully able to defend our laws, our borders, and their lives without any considerations of who might be offended by it!

Another day, another TSA fiasco

The stories just keep on piling up don’t they?

Here is another shameful episode brought to you by Janet Napolitano and the perverts working at TSA. A woman was singled out for a very invasive search after her pantyliner obscured the image screeners view of her genitals.

“This email isn’t going to be as polished as I would normally send, but I’m upset and I don’t want what happened to me to happen to anyone else (if I can stop it). I recently traveled via air, and was subjected to that new scanning device. “No problem,” I thought. I was wearing jeans and a linen tanktop, bra, panties, and one camoflauge pantyliner. I’m a rule follower, so I never have any problems at the airport. Not this time. I was stopped, and then held for 15 mintues while they tried to find a female supervisor. I couldn’t get to my bag, my shawl or my shoes; just standing there while the TSA agents kept me in one place. Now, I don’t want this to be about bad TSA agents; they were doing their job, they were as delicate as they could be, etc., etc. But what ultimately happened is that I was subjected to search so invasive that I was left crying and dealing with memories that I thought had been dealt with years ago of prior sexual assualts. Why? Because of my flannel panty-liner.

What do we really expect though? Look folks, we put poorly trained government employees, in the role of airport security, and insist that common sense  efforts like profiling NEVER EVER be used, and we place Janet Napolitano, who is dumber than a tree stump in charge of homeland security, what do we really expect?

Do we learn from what Israel does? No! Do we hire ex-military and police to run and enforce airport security? No! Do we use enhanced intelligence? No! Do we increase the presence of bomb sniffing dogs? No! Do we profile? Heavens no! That MIGHT, POSSIBLY, offend someone who is Muslim,and we would rather, it seems, offend EVERY passenger, than to risk offending that one person.

How expensive is political correctness? Take a flight and figure it out.
