City Shuts Down 11-Year-Old Selling Mistletoe To Fund Braces – Breitbart

An 11-year-old Oregon girl who wanted to help her father pay for her braces by selling mistletoe over the holidays, found herself embroiled in city bureaucracy. On Saturday, Madison Root went to the downtown market to sell fresh mistletoe she cut and wrapped herself from her uncle’s farm in Oregon.

She told KATU News, “I felt like I could help my dad with the money.”

However, a private security guard hired by Portland Saturday Market blocked her path to a straighter smile by telling her to stop selling the mistletoe, citing city rules that ban conducting business or soliciting at a park without proper approval and documentation.

Specifically, Chapter 10.12 of the Portland city code states that soliciting or conducting business includes the display of ”goods, or descriptions or depictions of goods or services, with the intent to engage any member of the public in a transaction for the sale of any good or service.”

The guard reportedly told Madison she could set up shop outside the boundaries of the park… or she could simply ask for donations. Her father, Ashton, told ABC.com, “The guard told her she can beg if she wanted but she can’t sell the mistletoe.” He went on to say that his daughter “does not want to encourage begging and wants people to earn their living… She is so keen on high work ethic.”

Madison confirmed this, “I don’t want to beg! I would rather work for something than beg. I wouldn’t think I’d have any problems because people are asking for money, people are selling stuff, this is a public place.”

The young entrepreneur also seemed confused that vendors could openly sell pot while her mistletoe business was shut down: “There are people next to me that have big signs that say ‘Got Pot?’ They’re raising money for pot.”

Pot or no pot, officials say vendors pay to rent vending booths and are screened before qualifying for the Portland Saturday Market. One vendor, Viki Ciesiul, explained the process to ABCNews.com saying “Applying for a booth is a juried process. I had to show samples of my jewelry to a panel of jurists… We have to pay to maintain our spot at the market.”

Ciesiul expressed mixed feelings about Madison’s plight: “We [vendors] are trying to avoid too many types of street vendors who might bring the place down,” she said. “There are many ways she can participate and rules are there for a reason.”

Mark Ross, a spokesman for the Portland Parks Bureau, which manages the city park said asking for donations is “a form of free speech, protected under the First Amendment,” but declined to comment about Madison’s story. He did note, however, that the Saturday Market administration designates and enforces its rules once the space has been leased to them.

Since the story broke Sunday evening, Madison’s father said “mistletoe orders mushroomed… even McKinzei Farms, one of the biggest selling Christmas tree farms in the area, made a $1,000 donation to Madison’s braces.”

The 11-year-old got her first set of braces on Monday.

Shooting at Oregon mall, two dead

There are reportedly at least two people dead — including the shooter — after a gunman opened fire at Clackamas Town Center Mall near Portland.

UPDATE: The Oregonian reports:

The Clackamas Town Center shooter has been “neutralized,” a spokesman for the Clackamas County Sheriff’s Office confirmed shortly before 5 p.m. [Pacific Time]
Lt. James Rhodes, a sheriff’s office spokesman, declined to say whether “neutralized” meant a suspect was dead, immobilized or in custody. Unconfirmed reports suggested that the assailant may have taken his own life after shooting multiple people at the mall. Two are confirmed dead with more injured.

US News is reporting the shooter is dead

Updated at 8:41 p.m. ET: A shooting at a mall in Portland, Ore., on Tuesday afternoon left three people dead, including the gunman, and at least one other person injured, police said.

Lt. James Rhodes of the Clackamas County Sheriff’s Office said the gunman shot two people to death and also died, but he did not say how the gunman died. Rhodes said another person was wounded and sent to a hospital.

The sheriff’s department is apparently waiting to name the gunman and, without a name, it is impossible to know the motive except (speculatively) he was a homocidal psychotic. A local resident informs me via Twitter that the mall is officially a “gun-free zone,” with signs at every entrance declaring “Firearms Prohibited.”

Homicidal psychotics aren’t real big on obeying signs like that.

Oregon law also prohibits carrying a gun within 1,ooo feet of  a school. there is a preschool in that mall

Historic Victory For GOP, Boehner Says Message To Obama Is “Change Course” – Daily Caller

Voters delivered an epic victory to Republicans and a stinging defeat to Democrats in midterm elections Tuesday, handing the GOP an avalanche of pickups in the House the likes of which has not been seen in more than half a century.

Republicans were on their way to gaining around 60 seats in the House, and had made huge advances in the Senate as well. GOP candidates also won big in governors races and state legislatures across the country.

The consolations for Democrats were few: they retained control of the Senate, Senate Majority Leader Harry Reid held on to his Nevada Senate seat, and Democrats won a few House races that were thought to be in danger.

The House currently has 255 Democrats and 178 Republicans. The new reality will be a Republican majority of between 236 and 240, and a Democratic minority below 200.

The GOP House gains were the biggest swing for either party since 1948, when Democrats gained 75 seats on the back of President Truman’s campaign against a “do-nothing” GOP Congress.

The last time such a large swing occurred in a midterm election was in 1938, when Democrats lost 72 seats to Republicans in the middle of President Franklin Delano Roosevelt s second term, as voters lost confidence in the New Deal.

In the Senate Tuesday, Republicans picked up seats in Arkansas, Indiana, Wisconsin, Illinois and Pennsylvania. They were on pace to win in North Dakota as well, and the Colorado race was too close to call, with Republican Ken Buck holding a lead of a few hundred votes.

The total pickup for the GOP in the Senate was set to be between 6 and 8 seats, depending on the outcomes in Colorado, Washington and Alaska. The latter two may not be decided for days.

Republicans also won a key gubernatorial race in Ohio and looked likely to win in Florida, both contests that President Obama and Democrats badly wanted to win. And 17 separate state chambers flipped from Democrat to Republican, in the latest count.

Republicans, however, said they were not celebrating.

“We’ve got real work to do, and frankly this is not a time for celebration, not when one out of 10 of our fellow citizens is out of work,” said John Boehner, the Ohio Republican who is set to become the next Speaker of the House.

Boehner said “our new majority will be prepared to do things differently,” saying they will cut spending instead of increasing it, which will be a much easier promise to make than it will be to fulfill.

And Boehner sought immediately to prevent Obama and the White House from sticking the new House Republican majority with full responsibility for the ship of state.

“We must remember it’s the president who sets the agenda,” Boehner said. The American people have sent an unmistakable message to him tonight, and that message is, ‘Change course.’”

Obama called Boehner around midnight “to congratulate him,” according to Boehner’s office.

“They had a brief but pleasant conversation. Leader Boehner said he’s always been straightforward and honest with the president in the past, and said that’s the way he’ll continue to be with the president in the future. They discussed working together to focus on the top priorities of the American people, which Boehner has identified as creating jobs and cutting spending,” Boehner’s office said.
