That said, I don’t agree with his foreign policy and I don’t like what I think I’m hearing now, that Republicans need to take the ‘social conservatism’ and chuck it. I don’t know what else he could mean in the above paragraph. “Diversity of opinion”? Telling other people “how to live”? “Republican Party that is more tolerant”?

Sorry, but I’m not a libertarian for a reason and I just can’t chuck my principles out the window either. As I’ve pointed out many times before, some of these so-called ‘tolerant’ views will infringe on my right to disagree with these views down the road. When we go the route that the left wants us to take, often times giving someone else a right means taking a right away from someone else.

In my view, this is not about “chucking” my, or anyone else’s principles. Paul is right about the Constitution leaving most decisions up to states and municipalities. And we DEFINITELY need to make the federal government as insignificant in our lives as possible, and, I would add making state government as insignificant in our lives at the state level, and definitely the same goes for county and city governments. It is called liberty. Sorry I DO NOT trust government to constrain itself, and I am not a fan of some Social Conservatives who want the government limited until THEY get offended by something, which is why I have disdain for groups like the American Family Association, and Conservatives like Rick Santorum. Now, Right Scoop IS correct in that we must guard against what the Left wants, which is to ban the ability to disagree with other’s choices, for example, Gay couples suing a bakery or florist who does not want to do their wedding. Businesses ought to have every right to NOT do business with anyone they damn well do not want to do business with. Again, THAT is liberty. And , I would think that taking power away from government would help in that venture. The fact is government at all levels is far too involved in our lives.

Like it or not those stances turn many folks off. Can we save companies like Hobby Lobby from Obamacare?

Hobby Lobby is a company run by Christians, and has vowed to not go along with parts of Obamacare

The owners of Hobby Lobby say they must remain true to their faith, despite the U.S. Supreme Court’s refusal to block the Obamacare contraception mandate.

Their attorney said the company will not provide the morning-after and week-after pills in its employee insurance plan when the health care mandate takes effect Jan. 1.

“The company will continue to provide health insurance to all qualified employees,” attorney Kyle Duncan said in a statement posted on Hobby Lobby’s website. 

“To remain true to their faith, it is not their intention, as a company, to pay for abortion-inducing drugs,” he said.

Hobby Lobby risks fines of more than a million dollars a day for ignoring the Obamacare mandate.

Let that sink in folks. The government will eventually bankrupt a corporation for not violating the deeply held faith of its owners. Freedom of religion? Not any more apparently. The Democrats, of course, tell us they are the “Party of  Working Americans”. Really? How will the war on Hobby Lobby, and other companies owned by people of faith serve those working for those companies? How will the death of Hobby Lobby benefit those working Americans? Or perhaps the Democrats are fine with more unemployed Americans. Maybe to them that just means more of us dependent on government, which seems to be the goal of the Democrats. The more dependency on government, the greater the chance Democrats will dominate the political power in America. And, yes, power is more important to the Left than putting the country first.

Michelle raises the point that we must stand with Hobby Lobby. A point I agree with entirely. But, if Hobby Lobby is being fined $1.3 million dollars a day, can we shop there enough to keep them afloat? The real issue with Hobby Lobby is this. They are not a company that will play ball with Team Obama. Companies that do play ball have received waivers from Obamacare. Now we are told these waivers are only temporary, but really, can we trust this administration to be honest about  that? This is the biggest issue here in the end. This administration, and likely future Democratic administrations will continue to play Chicago style politics. We, of course, have in our Constitution, constraints against government encroachment upon our rights. But, we also have a bunch of politicians who do not care about that document they took an oath to protect and defend. And, thanks to the gutlessness of the Chief-Justice of the Supreme Court, Obamcare is the law of the land. So, now what? Any ideas?

Soledad just does not get it, and never will. As you watch the videos at The Right Scoop understand this. Liberals, as OBrien is, have been taught to fear guns. The message that Liberals have been parroting for decades now is that guns, the NRA, and by extension, gun owners are bad. They have been brainwashed, in effect, to hate guns. She continues to say, during the videos that Lott wants to ban gun laws which I have never heard him say. She also parrots the “semi-automatic guns”  line. Every rifle, except for bolt-action rifles, are semi-automatic, meaning that as you fire one round, another round is loaded. You must pull the trigger each time to fire. The same is true, as Lott points out of the vast majority of guns in the country. Soledad, of course, does not grasp that. She does not debate as much as she emotes in the videos. To her, guns=bad and that is the end of it.

So, who edited CIA report on Benghazi?

General Patraeus testified today that he knew Benghazi was a terror attack almost immediately. The initial CIA report INCLUDED that an Al Qaeda linked terror group had carried out the attack. But, someone, edited that report, removing any link to terrorism, and those talking points were then given to U.N. Ambassador Susan Rice to repeat on five different Sunday shows. Megyn Kelly interviewed John Bolton, and The Right Scoop has the video

Former Ambassador John Bolton said that General Petraeus’ testimony this morning ‘put this dead cat right on the White House’s door step,” referring to Petraeus’ revelation that the CIA had included that it was a terrorist attack by an Al Qaeda linked group.

Bolton goes on to say that short of evidence to the contrary, the only explanation as to how the talking points on Benghazi were edited to remove references to Al Qaeda and Ansar Al Sharia is that the White House did it. And he says it’s perfectly consistent with the fact that top-level officials in intelligence and the State Department and elsewhere don’t have a clue who wrote the final talking points for Ambassador Rice.

My take is that the president, who was in full campaign mode at the time did not want us to know that Al Qaeda was not as on the run as he was saying on the campaign trail. In other words the White House, in my view, was simply playing politics here. Rice was given a pack of lies to tell, and she did so, whether she did so willingly or not might be argued.

It’s the judiciary’s Nixon-to-China: Chief Justice John Roberts joins the liberal wing of the Supreme Court and upholds the constitutionality of Obamacare. How? By pulling off one of the great constitutional finesses of all time. He managed to uphold the central conservative argument against Obamacare, while at the same time finding a narrow definitional dodge to uphold the law — and thus prevented the court from being seen as having overturned, presumably on political grounds, the signature legislation of this administration.

Why did he do it? Because he carries two identities. Jurisprudentially, he is a constitutional conservative. Institutionally, he is chief justice and sees himself as uniquely entrusted with the custodianship of the court’s legitimacy, reputation and stature.

Go read it all, I think Krauthammer is exactly right, but I disagree on one point. Roberts has, in my view, discredited ANY standing he had as a constitutional conservative. He placed his principles and his duty on the back burner to help the “image” of the Court? If so, then he has forgotten what duty is, and is a disgrace!

The Federal Government does not have the power to order people to buy health insurance. Section 5000A would therefore be unconstitutional if read as a command. The Federal Government does have the power to impose a tax on those without health insurance. Section 5000A is therefore constitutional, because it can reasonably be read as a tax.

I won’t have to unpack that for longtime readers of this site, but do allow me to unpack it — as I’ve done with similar linguistically incoherent statements in the past — for those who will spend today bemoaning a ruling that, when viewed from their own intepretative perspective (rather than their policy desires), they can’t honestly fault.

To wit:  “Section 5000A is therefore constitutional, because it can reasonably be read as a tax.”

Fine.  How is this the case?  Because, per Roberts,  the mandate looks something like a tax might look and could look — much in the way a cloud formation may look like a randy sheep three way, if you’re inclined to see it that way.  But unless you believe God or Nature intended to paint a sheep orgy in the gas and water vapor floating above Peoria, the clouds aren’t actually a sheep orgy save your intent to see it as such.

Intentionalism just is.

But, you argue, it clearly wasn’t intended as a tax (or if it was, there’s no way of ever knowing that, given that it was presented as a penalty and not a tax) — because the President publicly denied that it was a tax, and it was passed expressly as a penalty.  Therefore, it was signified into being — at the point of passage — as a penalty.  And a penalty is not a tax.

Or is it?

Intentionalism just is.

According to the CJ, a penalty is indeed a tax when it can be viewed as a tax for purposes of a ruling.  Meaning, a penalty is a tax when a Justice decides to rewrite the law to turn a penalty into a tax.  Which he justifies because the way the penalty looks to him suggests that “reasonable”  people (or philosopher kings) can, if they squint — and if they ignore the intent that turned the law into law in the first place, and turned a set of marks into a set of signs, into language — see a tax.  How that is “reasonable” is anyone’s guess:   we know in no uncertain terms that Obama and the Dems who passed the law didn’t devise the mandate as a tax (despite what they later argued); for one to conclude that it is reasonably possible to “read” a penalty as a tax,  therefore, what c0mes to count as “reasonable” must be redefined as “ignoring what we know to be true”.  And that seems antithetical to “reason.”

Having gone through the opinion, I am not going to beat up on John Roberts. I am disappointed, but I want to make a few points.

First, I get the strong sense from a few anecdotal stories about Roberts over the past few months and the way he has written this opinion that he very, very much was concerned about keeping the Supreme Court above the partisan fray and damaging the reputation of the Court long term. It seems to me the left was smart to make a full frontal assault on the Court as it persuaded Roberts.

Good Freaking Grief! Tell me Erickson is not this stupid. If Roberts was swayed by public opinion, or by what he perceived MIGHT be a negative spin the certain people, then he is unfit for the highest court! He is there to rule on the CONSTITUTIONALITY of laws, not make his decisions to impress anyone!

Second, in writing his case, Roberts forces everyone to deal with the issue as a political, not a legal issue.

The reality is that John Roberts have just given his stamp of approval on the biggest governmental encroachment on American liberty in our country’s history. This is not just about the individual mandate.

The supreme court has just set a legal precedent saying that it is okay for the federal government to force you to buy a service and penalize you if you don’t.

Now, thanks to John Roberts, if they decide it is in your best interest to buy a workout machine, a house alarm system, a book,  a Communist government indoctrination video — or anything else for that matter — they can do it and it will be simple labeled as a tax.

Why I would let the military handle the Mexican drug cartels

If I were the president, I would call in my military leaders, and tell them to handle these cartels. The reason is this. heavily armed, well trained cartels are invading on o0ur soil, endangering our citizens. our military is the best trained, most lethal force in the world, and they would have a free hand, by my order, to eradicate these vermin. And, if Flippy Calderon had an issue with it, well, too bad!

Here is a story, from the Houston Chronicle that illustrates my point

MCALLEN, Texas (AP) — A shooting that injured a sheriff’s deputy was the first indisputable case of spillover violence from the Mexican drug wars in Hidalgo County, the local sheriff said Monday.

Sheriff Lupe Trevino, who previously said there was no direct spillover violence in the Lower Rio Grande Valley, said the Sunday shootout erupted while one of his deputies investigated a reported kidnapping and drug deal.

“I have to say that with this particular incident, the way the witnesses and the information that we have gotten particularly in the federal system, this is the first recorded spillover violence event that we have experienced — and unfortunately got one of our deputies shot,” Trevino said.

One suspect was killed and two were wounded. In all, six people were taken into custody, including the alleged kidnapping victim, and are awaiting charges, the sheriff said.

The sheriff said a protective vest probably saved the life of Deputy Hugo Rodriguez, who was shot in the chest, abdomen and leg. He is recovering at a hospital.

Red at The Right Scoop raises an important point, this will only get worse!

The longer our borders are neglected and drug cartels are subsidized by the United States government (thank you Mr. Holder), the more spillover.  For those of us living in Border States, it’s nothing new.  In 2009, The University of Texas at Brownsville (waaaaaay down south by the Mexico border) was forced to close due to stray bullets from a drug war shoot out – in Mexico. But no one was injured.

Our military has a purpose, to DEFEND our land and our people. Well, this is a clear case for that isn’t it? These cartels, would not fare well against our Green Berets, or Seals. let them do what they do, it likely would not take them long. And these cartels would never even think of even crossing America’s border again. It sickens me that our leaders are so gutless frankly. They prefer to fight governors that try to stop illegal immigration than to fight these cartels.  I leave you with this from Sheriff Trevino

“Now, there are more cartel members living in Texas, in the Valley, in the United States. I’ll guarantee you there’s a ton of them,” he said.

These are nothing but vermin, and the sooner we stomp them into dust the better! And, of that means our military has to go onto Mexico, where these cartels are, then so be it! And, again, if Flippy Calderon does not like it, then fuck him!
