Texas Police Can Now Be Imprisoned For Not Honoring ICE Detainer Requests – Law Newz

A federal appeals court has allowed some aspects of Texas’s anti-Sanctuary City bill SB4 to go forward.

One of the more controversial provisions of SB4 is language which directs all law enforcement agents and officials in the state to “comply with, honor, and fulfill,” Immigration and Customs Enforcement (“ICE”) detainer requests. It reads, in relevant part:

Art. 2.251. DUTIES RELATED TO IMMIGRATION DETAINER REQUESTS. (a) A law enforcement agency that has custody of a person subject to an immigration detainer request issued by United States Immigration and Customs Enforcement shall: (1) comply with, honor, and fulfill any request made in the detainer request provided by the federal government; and (2) inform the person that the person is being held pursuant to an immigration detainer request issued by United States Immigration and Customs Enforcement.

The above-quoted provision is now being allowed to take effect pending further litigation. Thus, any police officers, chiefs or sheriffs who violate that provision – and refuse ICE detainer requests – will now be subject to criminal penalties…

Rep. Louie Gohmert called on Sen. John McCain’s constituency to recall the Arizona Republican who was recently diagnosed with brain cancer.

In pointing out that McCain repeatedly lied to voters about repealing Obamacare, the Republican congressman from Texas said the stress of being a lawmaker could add to McCain’s health concerns.

“You know, nothing inhibits recovery from cancer like stress.,” Gohmert said. “I think Arizona could help him and us. Recall him. Let him, you know, fight successfully this terrible cancer.

“And let’s get somebody in here that will keep the word he gave last year.”

While he is sure to be vilified, there is truth to the claim that stress is a concern when battling cancer…

Clarence Thomas Gets Spot In Smithsonian African-American History Museum – Washington Times

Just in time to celebrate its first anniversary, the Smithsonian’s National Museum of African American History and Culture has included a display featuring Justice Clarence Thomas, one of the U.S. Supreme Court’s conservative stalwarts.

Justice Thomas appears in an exhibit that was installed shortly before the one-year anniversary Sunday, a Smithsonian spokeswoman said Monday. The display honors both of the black justices who ascended to the pinnacle of the legal profession. The other is Thurgood Marshall.

Justice Thomas’ apparent omission irked conservative observers, who suspected an ideological bias among Smithsonian officials and called for the influential jurist’s inclusion in the museum.

Ronald D. Rotunda, distinguished professor of jurisprudence at the Dale E. Fowler School of Law at Chapman University, said Justice Thomas deserves to be recognized for his contributions to constitutional jurisprudence, his record of public service and his inspirational life story…

Detroit Is Once Again The Most Violent City In America, FBI Says – Monroe News

FBI data released Monday shows violent crime in Detroit surged 15.7 percent last year, an increase that ranked it as the nation’s most violent big city but one that city police officials disputed.

In 2016, there were 13,705 violent crimes reported – murder, rape, assault and robbery – in the city compared with 11,846 in 2015, according to the FBI’s 2016 Uniform Crime Report.

But Detroit Police Chief James Craig on Monday said the numbers were wrong, blaming an antiquated software system called CRISNET, which he said caused crimes to be reported twice. The system was replaced in December and shows a 5 percent reduction in violent crime last year, Craig said.

FBI Arrests Several NCAA Coaches Amid Broad Crackdown On College Basketball Corruption – Zero Hedge

In a broad crackdown on college basketball corruption, U.S. prosecutors unveiled charges Tuesday against 10 coaches, managers, financial advisers and representatives of a sportswear company, accusing them of bribery, fraud and corruption in recruitment in college basketball.

Additionally, a key part of the case includes allegations that an executive at a global apparel company bribed students to attend universities where the company sponsored athletic programs.

The Department of Justice announced Tuesday that college basketball coaches at University of Arizona, Auburn, University of Southern California, and Oklahoma State University had been arrested, as well as managers, financial advisors, and representatives of a major international sportswear company.

The defendants include coaches at top U.S. college basketball programs, one agent, one financial adviser and a former referee. The coaches are Lamont Evans, an assistant at Oklahoma State University, Emanuel Richardson, an assistant for the Arizona Wildcats, and Chuck Person, associate head coach at Auburn University…

Nashville Church Shooter Stopped By Usher With A Gun Of His Own – CNS

The Sudanese immigrant accused of opening fire in a Nashville church on Sunday, killing one woman outside and injuring six other people inside, was stopped by a church usher who also had a gun.

According to the Nashville Police Department:

As the gunfire was occurring, church usher Robert Caleb Engle, 22, confronted [suspect Emanuel Kidega Samson, 25] and engaged him in a struggle, which resulted in Engle being pistol whipped.

During the struggle, Samson’s gun discharged, striking him in the left chest. The wound sent Samson to the floor. Engle, despite his head injuries, ran out to his car in the parking lot and retrieved a pistol. He held Samson at gunpoint until police arrived. Samson was treated for his gunshot wound at Vanderbilt University Medical Center and discharged.

The suspect is scheduled to appear in court on Wednesday, and the motive “remains under investigation,” police said…

Steelers Coach Didn’t Want Army Vet To Stand For Anthem – Daily Caller

Pittsburgh Steelers head coach Mike Tomlin indicated Sunday night that he did not want offensive tackle Alejandro Villanueva to stand for the national anthem, instead of sitting it out with the rest of his teammates.

Villanueva, a former Army Ranger who served three tours in Afghanistan, was the only Steelers player to stand for the anthem. While Villanueva stood in the tunnel, hand over his heart, the rest of the team remained in the locker room in protest of President Trump’s comments that players who kneel during the national anthem should be fired.

Tomlin said in a post-game press conference that he was looking for “100 percent participation” in whatever course of action the team took during the national anthem.

When asked by a reporter about Villanueva coming out for the anthem, Tomlin said, “Like I said, I was looking for 100 percent participation, we were gonna be respectful of our football team.”…

NASCAR Owners Say They Wouldn’t Tolerate National Anthem Protests At Races – The Hill

Several NASCAR team owners said Sunday they would not condone racers protesting during the national anthem, amid protests by sports players at football and baseball games.

There were no protests reported during “The Star-Spangled Banner” at the Monster Energy NASCAR Cup Series in New Hampshire, according to The Associated Press.

Former NASCAR champion Richard Petty told the AP that any member of his team would be fired if they chose to protest the national anthem. Petty now owns Richard Petty Motorsports.

“Anybody that don’t stand up for the anthem oughta be out of the country. Period. What got ’em where they’re at? The United States,” Petty said in comments reported by the AP…

Uber Banned In London After Sexual Assaults By Migrants Skyrocket – InfoWars

Uber has been banned in London partly in response to skyrocketing rapes by predominantly migrant drivers which the company did not report to police.

According to Transport for London, Uber’s license will not be renewed beyond September 30, with the first reason listed being the company’s “approach to reporting serious criminal offenses.”

This includes Uber’s failure to report rising numbers of rapes and sexual assaults by its own drivers.

Latest figures show that Uber drivers are now responsible for one sex attack in London every week, with sexual assaults by Uber drivers skyrocketing by 50 per cent in just a single year.

This is undoubtedly connected to the fact that many of the drivers are from Muslim backgrounds, where “immodest” women are seen as easy prey. Many of the young women who hire Uber taxis late at night are drunk and in some cases scantily dressed.

Many Uber drivers are newly arrived migrants or “refugees” who don’t have to undergo the intensive training that traditional cabbies go through…

Education Secretary Betsy DeVos released interim guidance Friday on how colleges should handle sexual assaults on college campuses, the latest step in the Trump administration’s controversial rollback of Obama-era guidelines, in an effort to better protect both victims and students who are accused.

The agency withdrew a 2011 “Dear Colleague” letter that required schools to adopt a minimal standard of proof – the preponderance-of-the-evidence standard – when disciplining students and replaced a 2014 question-and-answer document on how schools should investigate and adjudicate cases of sexual misconduct.

The temporary guidance is meant to serve as a placeholder while the agency crafts news guidance with a new standard through a rulemaking process that involves public notice and comment.

Illegal Alien Breaks Into New Jersey Home, Sexually Assaults 6-Year-Old Girl – Daily Mail

A 32-year-old undocumented immigrant was charged with sexually assaulting a six-year-old girl after her father found the stranger in bed with her in the middle of the night, police say.

Edgar Mendoza, a citizen of Guatemala, allegedly broke into a home early Tuesday morning on Bayard Street in the Chambersburg section of Trenton, New Jersey, The Trentonian reported.

Police say in the affidavit that the child’s father noticed that a light had been turned off upstairs and went to investigate.

The concerned father walked into his daughter’s room to find Mendoza in her bed, authorities say.

Mendoza leaped up and then jumped from a second-floor window and fled on foot into the neighborhood, police say.

Police officers who responded to a 1.30am 911 call from the father searched the area and arrested Mendoza a short time later…

Oregon Dems Push Phony Precedent To Block Ninth Circuit Court Nominee – Washington Free Beacon

Oregon’s two Democratic senators are blocking one of President Trump’s judicial nominees with claims that a “longstanding” state tradition mandating that nominees be chosen from their “judicial selection committee” was violated, but the tradition they cite has never applied to picks for the U.S. Circuit Court, according to records viewed by the Washington Free Beacon.

Sens. Ron Wyden and Jeff Merkley alerted the White House that they would be blocking the nomination of Oregon native Ryan Bounds for a seat on the U.S. Circuit Court of Appeals for the Ninth Circuit. Bounds is currently serving as assistant U.S. Attorney for the District of Oregon.

Sen. John McCain of Arizona announced Friday afternoon that he will vote against his Republican colleagues’ last-ditch effort to repeal and replace Obamacare.

“I cannot in good conscience vote for the Graham-Cassidy proposal. I believe we could do better working together, Republicans and Democrats, and have not yet really tried,” he said in a statement Friday.

“Nor could I support it without knowing how much it will cost, how it will effect insurance premiums, and how many people will be helped or hurt by it. Couple Caught On CCTV Having Sex In Domino’s Pizza Shop Face Prison Time – Daily Mirror

A couple who had sex in a Domino’s pizza delivery shop are facing prison after they were caught on CCTV committing “lewd and obscene” acts. Daniella Hirst, 28 and Craig Smith, 31, were waiting for their stuffed crust pizza when they let their “exuberant spirits get the better of them”, a court heard.

An X-rated 18-minute clip shows Hirst performing a sex act on Smith up against the counter while several members of staff prepare food. At around half an hour long, the whole court hearing today was only around 12 minutes longer than the footage itself.

The footage, which was shown in court, first shows Hirst straddling a wet-floor sign before she is thrown in a sex position midair by Smith. She then slides down Smith’s trousers before appearing to perform a sex act – first standing and then crouching down on her knees.

The footage was shown at Scarborough Magistrates’ Court, where the pair faced charges of outraging public decency. Hirst, 29, pleaded guilty to the offence today and Smith, 31, was found guilty in his absence after a trial lasting barely 30 minutes…
