[T]he dean’s office of Utah Valley University, a public institution located in the north-central part of Utah, distributed a guidance letter to all faculty encouraging them to report to the school’s Behavior Assessment Team any students who use “inappropriate language,” are “argumentative,” or who speak “loudly.”

The letter, titled “Recognizing and Responding to Students of Concern,” was provided to The College Fix by a professor at Utah Valley. …

The professor who provided the memo to The Fix said it was distributed one day after an administrator told faculty at a back-to-school meeting that if they heard a statement that made Utah Valley University seem “less inclusive,” that statement should also be reported to the Behavior Assessment Team.

“I’m afraid that this Behavior Assessment Team is a bias response team in disguise,” said the professor, who asked to remain anonymous to avoid professional retribution.

“Bias” is a synonym for “thought crime.”

“Yes, even in a deep-red state at a university in one of the most conservative counties in America, faculty are afraid to speak their minds publicly if their opinions aren’t 100 percent politically correct,” the professor told The Fix.

The scholar added he sees the Behavior Assessment Team as “a tool of intimidation instead of a tool to foster inclusion.”

Liberals used to fight discrimination. Now, they perpetuate it

I ran across this piece at Campus Reform where Christina Hoff Sommers notes how the Left is killing free speech, debate, and critical thinking with their safe spaces, and “check your privilege” nonsense

Suppression of free speech, whether it’s designated free speech zones, safe spaces censoring speech, or students disrupting events, has become commonplace on college campuses.

At a Heritage Foundation panel discussion Thursday examining modern-day violations of the First Amendment, panelist Christina Hoff Sommers put the violations of free speech on campuses at the forefront of her discussion, saying that she has witnessed a marked deterioration in academic discourse over the years she has spent touring college campuses.

Now, of course, no one is allowed to dissent with any Leftist talking point. If they do they are demonized as some sort of “ist” or “phobe” racist, sexist, Islamaphobe, Homophobe. And, any attempt at honest, open debate? Not on the Neo-Marxists watch!

Sommers said many of the problems stem from “intersectional feminism,” a concept that she claimed began as an attempt to address the ill-treatment of minority groups within the feminist movement, but has since devolved into tribalism and the bullying of whites and males.

Instead of encouraging discussion and the formation of logical arguments, she pointed out, whites and males are now told to “check their privilege” and reflexively concede any position advanced by marginalized groups.

If you are not a woman or a minority, your opinions are discredited, not on their merit, but on your race or sex, which Sommers claimed is dividing people rather than bringing them together, because individuals are encouraged to identify with a specific race or gender, rather than simply identifying with all people.

Of course! The Left is dividing people, making them believe that everything about them is defined by their skin color, gender, or their “identity”. Their next step is to make everyone feel like a victim of mistreatment, and discrimination. In short, the Left, which used to rant against discrimination, is now creating it and using it for power. Everything has been flipped on its head.

Once being color blind was championed, but now, it is vilified as bigotry. Once, judging people by their skin color was, rightfully called out as bigotry. Now? Now everyone’s entire worth, or worthlessness is determine solely by their pigmentation. Once, Liberals spoke of open-mindedness, and dialogue, now?  Now such things will get you in deep trouble. In short, the Left is allowing their true colors to show.

Tolerance? Diversity? Ha! These are values the Left abhors. Instead the Left demands complete and total submission to their ideology. Anyone, even Liberals who oppose the Left’s goals are to be destroyed by any means necessary.

More than 100 students walked out on retired U.S. Army Lt. Colonel Allen West on Thursday as he began a speech at Saint Louis University to discuss the threat of radical Islam.

The students protesters — led by the SLU Rainbow Alliance and the Muslim Students’ Association — had arrived early and filled many of the seats in the two-story auditorium where West was slated to speak. As he took the stage they stood up and filed out.

At issue is West’s use of the term “radical Islam” — also the subject of his speech.

Last week an administrator at Saint Louis University told the conservative and Republican students organizing the talk that they were not allowed to use the words “radical Islam” on advertisements for the event, reported Young America’s Foundation, which sponsored the talk.

The hard truth about these indoctrinated egg heads is this. Their safe space involves them placing their heads directly up their behinds. They prefer being ignorant, and perpetually aggrieved to critical thinking and dealing with reality. Colonel West, as you might imagine, is not foolish enough to coddle these whiners. We should all follow his example. Nothing good will ever come out of anyone shutting down an exchange of ideas. If you are offended, or do not believe in ideals expressed, then please feel welcome to debate, or refute those ideals. Freedom of speech goes all ways folks. What these students did is nothing more than intellectual cowardice.

Another piece of Civil War history is about to bite the dust.

Portsmouth, Virginia is looking to remove a memorial to Virginians who served the Confederacy during the Civil War. It is falling victim to political correctness. There is a battle being waged with most wanting it to stay.

The memorial commemorates those soldiers who never returned home, it does not commemorate slavery, and most soldiers who fought overwhelmingly did not own slaves. It was also over 150 years ago.

The city estimates the taxpayers will have to pay about $105,000 to erase the monument and statues.

The courts will rule on the decision.

This is going on throughout the country, particularly in the south.

In South Carolina, where the first shots of the Civil War rang out in 1861, the state legislature voted to end the display of the Confederate flag on the grounds of the state capitol.

Monuments to the Confederacy in New Orleans  have been targeted. The Park and Recreation Board of Birmingham, Alabama, voted last July to remove that city’s Confederate Soldiers & Sailors monument.

This is all part of the Left’s campaign of indoctrination folks. First they demonize, then they destroy, all in the name of “inclusion” and “tolerance” of course. And, yes, yes, they will come for every last vestige of our Founders next. Are prepared to tolerate that too? Are we prepared to have a small minority of agitators dictate whom we memorialize? Remember that to truly destroy a nation, you destroy their heritage, history, and culture first. That is what the Left has been doing for decades now. There can be no question as to their goal here. The only question is will we allow it?

A former U.S. congressman urged Attorney General Loretta Lynch to arrest him after she warned on Thursday that her office would take a more aggressive approach to those spewing anti-Muslim rhetoric.

“I think Islam has a real freaking problem, alright?” Former Illinois Rep. Joe Walsh said in a video posted to his Facebook page. “There is a cancer in Islam, and if they’re not going to learn to assimilate, I don’t want them in this country.”

“You got a problem, Loretta Lynch, with me saying that? Then throw me in jail,” Walsh, a conservative talk show host, argued. “I think Islam is evil. I think Islam has a huge problem. I think most Muslims around the world are not compatible with American values. I don’t want them here.”

Walsh continued to slam Lynch in his video for the comments she made at Muslim Advocate’s 10th anniversary dinner one day after law enforcement officials say two people opened fire at a holiday party in San Bernardino, California, leaving 14 people dead and more than one dozen injured. According to reports, the wife pledged allegiance to the Islamic State on her Facebook page just moments before the attack.

“When we talk about the First Amendment we [must] make it clear that actions predicated on violent talk are not American. They are not who we are, they are not what we do, and they will be prosecuted,” Lynch said at the banquet. “My message not just to the Muslim community but to all Americans is: we cannot give in to the fear that these backlashes are really based on.”

Walsh, who now hosts his own radio program, served in Congress from 2011 to 2013.

In text that included some stronger language accompanying his video, which has been viewed more than 110,000 times as of Saturday morning, Walsh continued to argue that “most Muslims around the world are terrorists, support terrorism and/or support Sharia Law.”

“Any Muslim that is a terrorist or supports terrorism should be killed,” Walsh wrote. “If ‘Moderate’ Muslims don’t speak out against terrorism, they are our enemy and we should call them out and kick them out of this country.”

“Is that ‘anti-Muslim rhetoric’ that ‘edges toward violence,’” he continued. “Go ahead and prosecute me. I dare you.”

New Orleans Saints’ tight end Benjamin Watson used his Facebook account Tuesday to call attention to his views on the Black Lives Matter movement. A view that is critical of abortion, fathers who abandon their children and politicians who “enable generational dependency.”

Watson, the author of “Under Our Skin: Getting Real About Race – And Getting Free From The Fears and Frustrations That Divide Us,” is using social media to link people to a blog post where he discusses his thoughts on the Black Lives Matter movement.

“Some contention is with the very phrase itself. This is problematic, though, because ‘black lives matter’ in context is clearly comparative to them not mattering. It obviously does not exist in a vacuum thus a response of ‘all lives matter’ is disingenuous at best and outright insulting at worst,” Watson’s blog post from late August reads. “It SHOULD go without saying that ‘all lives matter,’ including black lives, unborn lives, elderly lives, affluent and poor lives, Christian and atheist lives. But, today, in light of our present societal struggles and racial tension the question is worth addressing. As Americans, do black lives matter to us?”

2) “Portland State University Offers Course Teaching How to ‘Make Whiteness Strange’… According to Portland State University Professor Rachel Sanders’ ‘White Privilege’ course, ‘whiteness’ must be dismantled if racial justice will ever be achieved. The course description states that ‘whiteness is the lynchpin of structures of racial meaning and racial inequality in the United States” and claims that ‘to preserve whiteness is to preserve racial injustice.’ Students taking the course will ‘endeavor to make whiteness strange.’ In order to make whiteness strange, the description says students must ‘interrogate whiteness as an unstable legal, political, social, and cultural construction.’”

3) “A University in the San Francisco Area Actually Told Students To Call 911 if They Were Offended… Administrators at a Catholic university in the San Francisco Bay Area have rescinded an official school policy instructing students to clog up the regional 9-1-1 emergency reporting system to report ‘bias incidents.’

The school is Santa Clara University, reports Campus Reform… Until this month, however, Santa Clara administrators have been instructing students to report ‘bias incidents’ using the emergency service reserved for dispatching police, firefighters and ambulances.

‘If the bias incident is in progress or just occurred: ALWAYS CALL 911 IMMEDIATELY,’ the Santa Clara website instructed students in fierce, all-capital letters.”

4) “Educators in the Volunteer State are very concerned that students might be offended by the usage of traditional pronouns like she, he, him and hers, according to a document from the University of Tennessee – Knoxville’s Office of Diversity and Inclusion.

In what appears to be a first for a serious presidential contender, Hillary Clinton’s campaign is going after five comedians who made fun of the former Secretary of State in standup skits at a popular Hollywood comedy club.

A video of the short performance, which is less than three minutes, is posted on the website of the renowned club, Laugh Factory, and the Clinton campaign has tried to censor it. Besides demanding that the video be taken down, the Clinton campaign has demanded the personal contact information of the performers that appear in the recording. This is no laughing matter for club owner Jamie Masada, a comedy guru who opened Laugh Factory more than three decades ago and has been instrumental in launching the careers of many famous comics. “They threatened me,” Masada told Judicial Watch. “I have received complains before but never a call like this, threatening to put me out of business if I don’t cut the video.”

Practically all of the country’s most acclaimed comedians have performed at the Laugh Factory and undoubtedly they have offended politicians and other well-known personalities with their standup routines. Tim Allen, Jay Leno, Roseanne Bar, Drew Carey, George Carlin, Jim Carrey, Martin Lawrence, Jerry Seinfeld and George Lopez are among the big names that have headlined at the Laugh Factory. The First Amendment right to free speech is a crucial component of the operation, though Masada drew the line a few years ago banning performers – including African Americans – from using the “n-word” in their acts.

The five short performances that Clinton wants eliminated include some profanity and portions could be considered crass, but some of the lines are funny and that’s what the Laugh Factory is all about. The video features the individual acts of five comedians, four men and a woman. The skits make fun of Clinton’s wardrobe, her age, sexual orientation, the Monica Lewinsky scandal and the former First Lady’s relationship with her famous husband. The Laugh Factory has appropriately titled it “Hillary vs. The First Amendment.”

Masada told Judicial Watch that, as soon as the video got posted on the Laugh Factory website, he received a phone call from a “prominent” person inside Clinton’s campaign. “He said the video was disgusting and asked who put me up to this,” Masada said. The Clinton staffer, who Masada did not want to identify, also demanded to know the names and phone numbers of the comedians that appear in the video. Masada refused and hung up. He insists that the comedy stage is a sanctuary for freedom of speech no matter who is offended. “Just last night we had (Emmy-award winner) Dana Carvey doing Donald Trump and it was hilarious,” Masada said.

It’s disappointing to see this response from college students, especially ones at a school with a highly regarded journalism program.

America has always prized the freedom of the press to report the news in the fairest way possible, and when students prevent that from occurring, they threaten the democratic process.

In the wake of a supposed racial controversy, the President of the University of Missouri has resigned.

The entire controversy began when a student, Jonathan Butler, began a hunger strike over alleged racial incidents. This weekend, Missouri football players decided to kind of sorta join the strike a bit. This morning, cowed faculty meekly walked out. Now the President has resigned.

In a letter to school officials posted on his Facebook page, Butler indicated that he began his hunger strike because someone in a pickup truck allegedly shouted a racist insult at a black student government member, because state law prevents Planned Parenthood from performing on-campus abortions and because someone drew a swastika with human feces in a dormitory bathroom.

Some observers have suggested that the bathroom swastika may be a hoax. Why, law professor blogger Ann Althouse has asked, for example, would any dedicated racial supremacist create a swastika out of human feces?

Butler admits in the letter that none of the incidents he cites are Wolfe’s fault. Nevertheless, Butler has concluded, “as a collection of incidents at the university, they are his responsibility to address.”

This summer, prior to Butler’s decision to go on a hunger strike because of racism allegations, the graduate student’s substantially different agenda focused on a change in University of Missouri policy which ended subsidized health insurance for graduate students. To Butler’s chagrin, school officials also stopped offering certain grad student tuition waivers and tore down some graduate student housing.

At the end of the day, this isn’t a courageous strike against racism. It’s a lazy strike against practicing for a bad football team. The fact that the media isn’t reporting it this way is evidence of the media’s own laziness.

Here’s The List Of Demands From Mizzou’s Protesting Athletes, Students – Saturday Down South

The Legion of Black Collegians and others (including football players) associated with the boycott at Missouri stemming from racial tension on Saturday published a list of demands they want met before things return to somewhat normalcy.

Here’s the list in its entirety:

1. We demand that University of Missouri System President, Tim Wolfe, writes a hand-written apology to Concerned Student 1-9-5-0 demonstrators and holds a press conference in the Mizzou Student Center reading the letter. In the letter and at the press conference, Tim Wolfe must acknowledge his white privilege, recognize that systems of oppression exits, and provide a verbal commitment to fulfilling Concerned Student 1-9-5-0 demands. We want Tim Wolfe to admits his gross negligence, allowing his driver to hit one of the demonstrators, consenting to the physical violence of bystanders, and lastly refusing to intervene when Columbia Police Department used excessive force with demonstrators.

2. We demand the immediate removal of Tim Wolfe as UM system president. After his removal, a new amendment to thd UM system policies must be established to have all future UM system president and Chancellor positions be selected by a collective of students, staff, and faculty of diverse backgrounds.

3. We demand that the University of Missouri meets the Legion of Black Collegians’ demands that were presented in the 1969 for the betterment of the black community.

4. We demand that the University of Missouri creates and enforces comprehensive racial awareness and inclusion curriculum throughout all campus departments and units, mandatory for all students, faculty, staff and administration. This curriculum must be vetted, maintained, and overseen by a board comprised of students, staff and faculty of color.

5. We demand that by the academic year 2017-18, the University of Missouri increases the percentage of black faculty and staff members campus-wide by 10 percent.

6. We demand that the University of Missouri composes a strategic 10-year plan on May, 1 2016 that will increase retention rates for marginalized students, sustain diversity curriculum and training, and promote a more safe and inclusive campus.

7. We demand that the University of Missouri increases funding and resources for the University of Missouri Counseling Center for the purpose of hiring additional mental health professionals, particularly those of color, boosting mental health outreach and programming across campus, increasing campus-wide awareness and visibility of the counseling center, and reducing lengthy wait times for prospective clients.

8. We demand that the University of Missouri increases funding, resources and personnel for the social justice centers on campus for the purpose of hiring additional professionals, particularly those of color, boosting outreach and programming across campus and increasing campus-wide awareness and visibility.

The IRS did mishandle tea party and conservative groups’ nonprofit applications, but their behavior didn’t break any laws, the Justice Department said in a letter to Congress Friday that cleared the tax agency and former senior executive Lois G. Lerner of any crimes.

“Ineffective management is not a crime,” Assistant Attorney General Peter J. Kadzik said in a letter to the House Ways and Means Committee. “The Department of Justice’s exhaustive probe revealed no evidence that would support a criminal prosecution. What occurred is disquieting and may necessitate corrective action – but it does not warrant criminal prosecution.”

The decision comes more than two years after the IRS’s internal watchdog reported that auditors singled out tea party groups’ applications for special scrutiny and delayed those applications beyond reasonable timelines, preventing the groups from being able to say they were officially recognized nonprofits.

The agency initially admitted its bad behavior, and President Obama vowed an investigation – but he later said, in the middle of the probe, that there was no evidence of corruption.

Some Republicans have questioned the validity of the probe from the beginning, after learning that one of the Justice Department lawyers assigned to the investigation was a contributor to Mr. Obama’s political campaigns.

In its letter Friday the Justice Department specifically cleared Ms. Lerner, a senior executive in charge of approving the groups’ applications, who had authored a number of emails that suggested a bias against the tea party movement.

Investigators said none of the witnesses they interviewed believed Ms. Lerner acted out of political motives, and said that Ms. Lerner seemed to try to correct the inappropriate scrutiny once she “recognized that it was wrong.”

“In fact, Ms. Lerner was the first IRS official to recognize the magnitude of the problem and to take concerted steps to fix it,” Mr. Kadzik wrote.

Well damn it looks like the fix is in. The good people at the Federalist found out that the judge who has blocked footage from being released in the fourth Planned Parenthood is not only an Obama appointee, but he raised a whole lotta money for his campaign:

A federal judge late Friday granted a temporary restraining orderagainst the release of recordings made at an annual meeting of abortion providers. The injunction is against the Center for Medical Progress, the group that has unveiled Planned Parenthood’s participation in the sale of organs harvested from aborted children.

Judge William H. Orrick, III, granted the injunction just hours after the order was requested by the National Abortion Federation.

Orrick was nominated to his position by hardline abortion supporter President Barack Obama. He was also a major donor to and bundler for President Obama’s presidential campaign. He raised at least $200,000 for Obama and donated $30,800 to committees supporting him, according to Public Citizen.

Even though the National Abortion Federation filed its claim only hours before, Orrick quickly decided in their favor that the abortionists they represent would, ironically, be “likely to suffer irreparable injury, absent an ex parte temporary restraining order, in the form of harassment, intimidation, violence, invasion of privacy, and injury to reputation, and the requested relief is in the public interest.”

You think maybe Judge Billy might be slightly biased towards the left? Sounds mighty suspicious to me.

Yes, Donald Trump Is A Douchebag Who Often Speaks Without Thinking…

And yes, when he said that John McCain is only considered a war hero because he got caught by the enemy, that was not only douchey, it was untrue. John McCain is a hero because he was offered a chance to be released early from captivity and refused to go, knowing that to do so would mean taking the place of another POW who had been there longer and deserved to be set free ahead of him.

What Trump said was petty and ignorant, and he owes McCain an apology for it, but that doesn’t mean he’s been wrong about practically everything else he’s said about McCain, nor does it mean he has gone out of his way to intentionally insult every POW in American history.

Let’s face it, the guy is a carnival barker who’s made his living in recent years firing people on television for fun and profit. To suspect that he thinks with greater depth than a mud puddle about most issues before commenting on them during an interview is unrealistic, to say the least. Furthermore, to suppose that he hates all POWs because he made an off-the-cuff statement designed to hurt John McCain’s feelings is a stretch, but if he has any brains in his head he will man-up and beg the forgiveness of every former POW still alive (except Bowe Bergdahl) for talking out of his ass about something he is completely unqualified to discuss.

If he does so, perhaps in time people will start to remember that the only things Trump has said about our veterans with any forethought at all is that they’ve been treated like third-class citizens by our federal government for decades, and that the V.A. health care system is a disgraceful joke. The Donald has said these things over and over again, so why aren’t most of the other GOP candidates talking about them? I mean, it’s not like these opinions aren’t firmly anchored in the truth!

Trump has also made illegal immigration a front-page news story again, something that I guarantee most of the other Republicans in the race want to ignore like Bruce Jenner’s twitter account. In fact, I can only think of a few of the current 15 who wouldn’t have put that issue on the back-burner this campaign season had it not been thrown in all their faces so forcefully.

So why did Donald Trump even bring these subjects up in the first place? I believe it’s because he’s a populist who will say pretty much whatever he thinks people want to hear to get elected, but then I’m a cynical bastard when it comes to the thought processes of politicians.

No matter what his motives may be, however, at least he’s talking about things that genuinely matter; things that the vast majority of conservatives have been begging their elected representatives to deal with since forever, only to have those issues dropped like hot potatoes over and over again.

Yes, Trump is a blowhard and a media whore, but the fact that he’s also the only GOP candidate who has repeatedly proclaimed Hillary Clinton to be an out-and-out criminal – which she clearly is – has caused many millions of people to perk up their ears and say: IT’S ABOUT FREAKIN’ TIME SOMEBODY SAID THAT!

When The Donald points out that America consistently loses untold billions of dollars to it’s trade partners year after year, and that we are essentially building China’s infrastructure and military while ours goes to hell in a handbag, people stand up and cheer because they know he’s right. And when he says he would do a lot better than the inept clowns we’ve put in charge of our trade policies since the 1980s, folks tend to believe him. Why? Because despite his arrogant public demeanor and mockable hair style, he probably would!

Moreover, when Trump gives a speech on practically any topic, his audiences take heart in the fact that, despite his many, MANY flaws, at least he won’t be another squishy, establishment Republican who will play Mr. Nice Guy when confronted by the Clinton political machine and Hillary’s leftist minions in the Jurassic press.

The main reason why Trump has gained so much momentum in recent weeks is because people don’t see him as a pushover or a loser, and the GOP base is sick to death of getting their heads handed to them by a pack of socialist dirtbags who are more than happy to arm Islamic terrorists while simultaneously disarming American citizens. They are tired of seeing their top political candidates fold like paper kites in a hurricane every time they are confronted by the left over some invented media controversy about something they said that no right-winger would ever consider controversial.

In essence, Republican voters are begging their candidates to grow some balls and tell these Marxist parasites to go pound sand once and for all, and the only one they see with a bulge in his pants right now is Donald Trump.

A lady friend of mine asked me the other day what I thought of The Donald, and my answer was basically this: I don’t like him very much at all. I think he’s a self-centered, loud-mouthed prick who probably knows a lot less about the issues he discusses than he wants you to believe. Yet, despite all his negative attributes, I’d still vote for him if he were to win the GOP nomination because at least he has some positive leadership qualities, and I don’t see him becoming the sock-puppet of any special interest group anytime soon. What does Hillary Clinton have to offer, other than a closet full of pantsuits and a long history of corruption and failure?

Would I rather see somebody like Ted Cruz or Scott Walker win the primary election? Of course, who in their right mind wouldn’t? That having been said, whoever becomes the Republican nominee had better damned well take a page from the Trump campaign handbook and start hammering Hillary relentlessly over genuine scandals like Benghazi and e-mailgate because if they don’t, you can stick a fork in this once-great nation of ours. It’s all done!

The Wisconsin Supreme Court has effectively killed the “John Doe” case which led to home raids and intimidation of a wide range of Wisconsin conservative activists.

The decision is embedded at the bottom of this post.

Here is the key finding, which completely shreds both the legal theories and motives of the prosecutors, completely vindicates the targets, and praises those who fought back legally against prosecutorial misconduct (emphasis added):

¶133 Our lengthy discussion of these three cases can be distilled into a few simple, but important, points. It is utterly clear that the special prosecutor has employed theories of law that do not exist in order to investigate citizens who were wholly innocent of any wrongdoing. In other words, the special prosecutor was the instigator of a “perfect storm” of wrongs that was visited upon the innocent Unnamed Movants and those who dared to associate with them. It is fortunate, indeed, for every other citizen of this great State who is interested in the protection of fundamental liberties that the special prosecutor chose as his targets innocent citizens who had both the will and the means to fight the unlimited resources of an unjust prosecution. Further, these brave individuals played a crucial role in presenting this court with an opportunity to re-endorse its commitment to upholding the fundamental right of each and every citizen to engage in lawful political activity and to do so free from the fear of the tyrannical retribution of arbitrary or capricious governmental prosecution. Let one point be clear: our conclusion today ends this unconstitutional John Doe investigation.

Andrew Grossman, who filed an amicus brief in the Supreme Court case and who has served as counsel to Eric O’Keefe and the Wisconsin Club for Growth (two of the targets of the investigation) in various federal civil rights litigation against the prosecutors, provided me with the following statement:

Today’s decision puts an end to one of the worst abuses of power ever seen in Wisconsin law enforcement. The next step will be holding those responsible accountable for their actions. The Court’s recognition that the John Doe was a politically motivated “dragnet” of Gov. Walker’s allies provides strong support for Cindy Archer’s civil rights action against the Milwaukee prosecutors and lawsuits by potentially any of the other John Doe targets.

Analysis:

The court found that Wisconsin statutes did not limit “issue advocacy,” and that any attempt to so limit speech was unconstitutional:

¶7 We can resolve the original action, Two Unnamed Petitioners, by first examining whether the statutory definitions of “committee,” “contributions,” “disbursements,” and “political purposes” in Wis. Stat. §§ 11.01(4), (6), (7), and (16) are limited to express advocacy[4] or whether they encompass the conduct of coordination between a candidate or a campaign committee and an independent organization that engages in issue advocacy. Second, if the definitions extend to issue advocacy coordination, what then constitutes prohibited “coordination?”

¶41 We turn first to Two Unnamed Petitioners, the original action filed with the Wisconsin Supreme Court. This case requires us to interpret Wisconsin’s campaign finance law, Wis. Stat. Ch. 11. By its very nature, this task involves fundamental questions regarding the scope of the government’s ability to regulate political speech. To resolve this case, we must engage in statutory interpretation of the phrase “political purposes,” which includes all activities “done for the purpose of influencing [an] election.” Wis. Stat. § 11.01(16). We conclude, consistent with the First Amendment of the United States Constitution and Article I, Section 3 of the Wisconsin Constitution, that the plain language of “political purposes” in Wis. Stat. § 11.01(16) is unconstitutionally overbroad and vague if it is not given a limiting construction and applied to only express advocacy and its functional equivalent. This conclusion invalidates the special prosecutor’s theory of the case and ends the John Doe investigation. Therefore, we agree with the Unnamed Movants and grant their requested relief.

The Court ripped into the investigating prosecutors (emphasis added):

¶68 Having reached our conclusion about the scope of conduct regulated by Chapter 11, we now turn to the special prosecutor’s theories of coordination and whether the alleged conduct is regulated under Wisconsin law.[23] The special prosecutor has disregarded the vital principle that in our nation and our state political speech is a fundamental right and is afforded the highest level of protection. The special prosecutor’s theories, rather than “assur[ing] [the] unfettered interchange of ideas for the bringing about of political and social changes desired by the people,” Roth, 354 U.S. at 484, instead would assure that such political speech will be investigated with paramilitary-style home invasions conducted in the pre-dawn hours and then prosecuted and punished. In short, the special prosecutor completely ignores the command that, when seeking to regulate issue advocacy groups, such regulation must be done with “narrow specificity.” Barland II, 751 F.3d at 811 (quotations omitted).

¶69 The limiting construction that we apply makes clear that the special prosecutor’s theories are unsupportable in law given that the theories rely on overbroad and vague statutes. By limiting the definition of “political purposes” to express advocacy and its functional equivalent, political speech continues to be protected as a fundamental First Amendment right.

The court made clear the investigation was stopped cold in its tracks:

¶76 To be clear, this conclusion ends the John Doe investigation because the special prosecutor’s legal theory is unsupported in either reason or law. Consequently, the investigation is closed. Consistent with our decision and the order entered by Reserve Judge Peterson, we order that the special prosecutor and the district attorneys involved in this investigation must cease all activities related to the investigation, return all property seized in the investigation from any individual or organization, and permanently destroy all copies of information and other materials obtained through the investigation. All Unnamed Movants are relieved of any duty to cooperate further with the investigation.

The Court went on in addition to uphold a lower court’s quashing of a subpoenas and search warrants sought by the prosecutors, finding that the John Doe powers did not allow “a fishing expedition”:

¶91 Reasonableness and particularity are not just requirements of search warrants, however. Subpoenas issued by courts, and by extension John Doe judges, must also satisfy these requirements of the Fourth Amendment. In re John Doe Proceeding, 272 Wis. 2d 208, ¶38. A John Doe proceeding, with its broad investigatory powers, must never be allowed to become a fishing expedition.

¶92 It is difficult, if not impossible, to overstate the importance of the role of the John Doe judge. If he does not conduct the investigation fairly, as a neutral and detached magistrate, the risk of harm to innocent targets of the investigation-and we remain mindful that all such targets are presumed innocent-is too great. Through the use of a John Doe proceeding, “law enforcement officers are able to obtain the benefit of powers not otherwise available to them, i.e., the power to subpoena witnesses, to take testimony under oath, and to compel the testimony of a reluctant witness.” Washington, 83 Wis. 2d at 822-23. Such powers, if not wielded with care and skill may serve to transform a John Doe proceeding into an implement of harassment and persecution by a vengeful or unethical prosecutor. Thus, John Doe judges must be mindful of this danger and zealously guard the rights of all citizens against over-reach.

The Court then summarized its holdings, just so there was no doubt that it had completely rejected the prosecutors’ legal theory on coordination of issue advocacy (emphasis added):

¶133 Our lengthy discussion of these three cases can be distilled into a few simple, but important, points. It is utterly clear that the special prosecutor has employed theories of law that do not exist in order to investigate citizens who were wholly innocent of any wrongdoing. In other words, the special prosecutor was the instigator of a “perfect storm” of wrongs that was visited upon the innocent Unnamed Movants and those who dared to associate with them. It is fortunate, indeed, for every other citizen of this great State who is interested in the protection of fundamental liberties that the special prosecutor chose as his targets innocent citizens who had both the will and the means to fight the unlimited resources of an unjust prosecution. Further, these brave individuals played a crucial role in presenting this court with an opportunity to re-endorse its commitment to upholding the fundamental right of each and every citizen to engage in lawful political activity and to do so free from the fear of the tyrannical retribution of arbitrary or capricious governmental prosecution. Let one point be clear: our conclusion today ends this unconstitutional John Doe investigation.

¶134 In Two Unnamed Petitioners, we hold that the definition of “political purposes” in Wis. Stat. § 11.01(16) is unconstitutionally overbroad and vague under the First Amendment to the United States Constitution and Article I, Section 3 of the Wisconsin Constitution because its language “‘is so sweeping that its sanctions may be applied to constitutionally protected conduct which the state is not permitted to regulate.’” Janssen, 219 Wis. 2d at 374 (quoting Bachowski, 139 Wis. 2d at 411). However, a readily available limiting construction exists that we will apply and that will prevent the chilling of otherwise protected speech; namely, that “political purposes” is limited to express advocacy and its functional equivalent as those terms are defined in Buckley and WRTL II. With this limiting construction in place, Chapter 11 does not proscribe any of the alleged conduct of any of the Unnamed Movants. The special prosecutor has not alleged any express advocacy, and issue advocacy, whether coordinated or not, is “beyond the reach of [Ch. 11].” Barland II, 751 F.3d at 815. Accordingly, we invalidate the special prosecutor’s theory of the case, and we grant the relief requested by the Unnamed Movants.

¶135 To be clear, this conclusion ends the John Doe investigation because the special prosecutor’s legal theory is unsupported in either reason or law. Consequently, the investigation is closed. Consistent with our decision and the order entered by Reserve Judge Peterson, we order that the special prosecutor and the district attorneys involved in this investigation must cease all activities related to the investigation, return all property seized in the investigation from any individual or organization, and permanently destroy all copies of information and other materials obtained through the investigation. Macy’s spat with Donald Trump seems to be costing the company dear – sources close to the department store say it is being inundated with complaints by customers.

Apparently the company has already received letters, phone calls and online messages from around 30,000 Trump supporters, many of whom have claimed to have cut up their store card.

The irate customers are accusing the company of being against free speech after it cut ties with the Republican presidential candidate two weeks ago over his inflammatory comments about Mexican immigrants.

His supporters believe Macy’s – which sold Trump’s menswear collection for 11 years – is unjustly punishing him for his views on immigration, sources told TMZ.

The complaints include countless messages on Facebook and Twitter. Sue Reymann Garrett wrote: ‘I will be boycotting Macy’s. If they don’t want Trump I don’t want Macy’s. I will cut up me [sic] Macy’s card!’

Jake Graham posted: ‘I will no longer shop at your store. Chicago. Trump will be our next President. Shame on you Macy’s!!!!!’

Nino Castilano said: ‘I will be cutting up my macy’s card and you guys will no longer get me or my friends’ business any more for what you guys did to Donald J. Trump… I’ve been a proud customer for 20 years… well not any more…’

Ken Sheets added: ‘Apparently as far as I can tell, Macy’s supports illegal immigration, a fact pointed out by dismissing D Trump due to his stance on illegal immigration, and in turn I am dismissing Macy’s by not patronizing this establishment any further.’

Trump, who called for the boycott of Macy’s, has been thanking his supporters over Twitter for doing just that.

‘I am so happy that people are boycotting Macy’s,’ he said in a tweet yesterday.

In an earlier message he wrote: ‘Thx [sic] to all the people who called to say they are cutting their Macy’s credit card as a protest against illegal immigrants pouring into US.’

A Macy’s spokesman told TMZ: ‘Our Facebook page is often times used by our customers to express their feelings or points of view. Many times it does not correlate to any action.’

Trump began his tirade against Mexican immigrants when he announced on June 16 that he would be entering to race to become the Republican presidential candidate.

He said then: ‘When Mexico sends its people, they’re not sending their best. They’re sending people that have lots of problems. They’re bringing drugs. They’re bringing crime. They’re rapists.

‘I will built a great wall – and nobody builds walls better than me, believe me – and I’ll build them very inexpensively. I will build a great, great wall on our southern border, and I will make Mexico pay for that wall. Mark my words.’

Macy’s isn’t the only corporation to have severed ties with Trump. Mattress giant Serta, for instance, has said it will stop selling Trump-branded products, while Univision and Comcast’s NBCUniversal have cancelled plans to broadcast Trump’s Miss Universe beauty pageant.

Trump is suing Univision for $500million and has threatened legal action against NBC, among others.
